More cameras, more fines, more money but the road toll continues to increase!

Wow! Where on earth did the last 3 months go and how is it almost Christmas again???

There has been so much going on in the background here at ASF and we are very excited about our plans for 2020. Unfortunately, before that happens, the revenue raising ‘policy enforcers’ will be out, doing their bit to bring in as much extra money for the various state governments between now and the end of the year.

– It’s all about the money!

We’re confident that, by now, everyone reading this e-mail update is more than aware that the current system of fines in this country is simply about revenue raising but, should there be any ‘newbies’ to these updates who still have their blinders on, the following article should clarify things pretty quickly:

You’ll note that the heading doesn’t say that accidents have gone through the roof, fatalities have increased dramatically or, in fact, anything at all about ‘road safety’ – in fact, the whole point of the article is that the on-going Fines Victoria crisis is really only affecting the State’s bottom line!

Now, the great news for all Victorian motorists, of course, is that the entire system of revenue raising in the State is in shambles and that is primarily due to the sheer number of people that are refusing to blindly ‘pay up’ and are using our information to challenge their fines and fight back against this corruption and blatant revenue raising, which is great to see.

 As the author simply puts it, “The software system used by Fines Victoria to collect court fines and infringements for parking, red-light camera and speeding offences does not work …”  The article goes on to focus purely on how much ‘lost revenue’ the failed Fines Victoria system has cost, with some councils whinging about how much ‘good’ they could have done for the community if the fines system had, in fact, enabled them to continue fleecing completely innocent motorists of their hard earned money, simply to ‘prop up’ costly (and probably completely un-necessary) public projects that should have been budgeted and paid for with legitimately raised revenue instead of ill-gotten gains!

This basic revenue raising premise is backed up by this article – https://www.seniordriveraus.com/victorians-still-being-gouged-with-speed-fines/ – which clearly explains how Victorian motorists are being ‘gouged’ with speeding fines because the State government is “more addicted to the revenue they provide than ever before”.

The article goes onto to mirror what we have been saying for well over a decade now – if more fines are being issued and cameras truly work the way the government claims they do, by causing motorist to slow down, then why is the road toll increasing, along with the amount of revenue being raised???

It also mirrors the pretty obvious fact that we have been trying to get through to people for some time now – that if that many drivers are being fined for ‘exceeding the speed limit’ then the speed limit is clearly set too low!

The closing line really does sum it all up perfectly – “The system is patently broken, but nothing is being done to fix it. Instead, speed limits continue to be reduced, fines continue to be increased, and people continue to die.”

And then, as the final nail in the coffin, there’s this news story – https://www.3aw.com.au/we-dont-speed-new-data-shows-most-australians-drive-below-the-speed-limit/ – which explains that most Aussies actually already drive below the speed limit anyway so all the government claims about “speed kills” are completely incorrect because we’re essentially driving slower but the road toll continues to rise!

More cameras, more fines

In line with what we have detailed in the section above, the various State governments around the country are so dependent on revenue from unjust and unlawful fines, they are continually working on new ways to issue even more of them, irrespective of the fact that the road toll continues to rise, despite the massive increase in fines.

In NSW, the government is turning on their new, highly invasive, cameras to catch drivers on their phones, which we have reported on before. This article – https://7news.com.au/technology/nsw-mobile-phone-cameras-to-switch-on-everything-drivers-need-to-know-c-583268 – details that the trial run of these cameras (that we covered in an previous update) is now being implemented as a permanent strategy to raise more revenue.

Whilst we certainly agree that people should not be using their phones whilst driving, as distracted drivers truly are one of the biggest killers on our roads – not speeding drivers as they constantly try and claim – the government has absolutely no right to just photograph people, without their consent, without any evidence that they have done anything wrong, in the ‘hope’ of maybe catching someone on their phone.

And, as we have said before, if they increased the speed limits then motorist wouldn’t be so bored that they felt like they needed, or wanted to touch their phone, they would be 100% focussed on driving safely – just they do on the autobahns in Europe.

This sister article – https://7news.com.au/lifestyle/motoring/nsw-motorists-last-warning-to-put-down-mobiles-as-detection-cameras-go-live-c-581274 – also explains that the cameras won’t be marked in any way, which is further proof that it is all about revenue raising and not actually about getting people to put down their phones.

In fact, the 2nd last line of the article contradicts the entire argument because they claim that they want people to “change their behaviour behind the wheel – not three weeks later when they get a fine in the mail” yet, by implementing this system, that’s the best they can hope for!

As always, what is needed is better driving training and education, not simply harsher ‘enforcement’!

And, as if that wasn’t bad enough for NSW motorists, the government is also scrapping the warning signs about speed and red light cameras as well, as this article details – https://7news.com.au/news/sydney-news/nsw-drivers-wont-receive-warning-signs-about-speed-and-red-light-camera-as-government-moves-to-scrap-them-c-538472?fbclid=IwAR12tw-mBhNbOi74cH_EQEay-k5nhUztPoVM4Nzn1xKPjsvHHTnWXRcKakc&utm_source=lm.facebook.com&utm_medium=referral

Once again, if these cameras really were about causing people to slow down – which, as we explained in the section above, they are already doing – then, clearly, removing the signs would have an adverse affect. However, given that these cameras exist purely to raise revenue, it is easy to see why removing the signs is an obvious benefit – to the government!

The article details completely baseless claims about a very specific (54) number of lives that the removal of these signs could somehow, magically make, despite the fact that more cameras have been installed, more fines have been issued and, yet, the road toll has increased significantly! It will come as absolutely no surprise that they don’t bother mentioning how much extra money they will make from removing those warning signs but they do mention that revenue from cameras is set to double with the introduction of the new mobile phone cameras!

If the government continues to escalate their ‘war on motorists’ it may be time for Aussies to start following the lead set by other motorists around the world. As this article explains – https://www.thenewspaper.com/news/68/6844.asp – motorists in Europe have simply had enough of these blatant revenue raising cameras and are taking matters into their own hands to deal with them.

It is just astonishing to read that almost 18,000 cameras were attacked in the past 2 years in France and yet here, Aussie motorists continue to sit on their apathetic backsides, handing over their hard earned money!!!

– Drunk and drug affected driving

Before we even begin on this section, we want to make it crystal clear that we do not in any way condone drunk and/or drug affected driving at all. Quite simply, if you’ve had a drink or taken drugs then do not drive!

 Now, having said that, there are definitely some issues with the current system of enforcement of drunk and drug affected drivers that people should be aware of. Firstly, as this article details – https://www.naturalnews.com/2019-11-11-alcohol-breathalyzers-based-on-sham-science-investigation.html – a new study has shown that breathalyzer tests are nowhere near as accurate as the ‘authorities’ have made them out to be.

We want to make it clear that, unlike the US, where this article is from, the police here do not usually rely solely on a breathlyzer result – that’s why they are referred to as a ‘preliminary breath test’. You will usually be fined, or charged, based on the result of a secondary, or ‘evidentiary breath test’. The issue is, however, that if the preliminary breath test was inaccurate, then you should not have been required to take the evidentiary breath test and thus, the evidence that they obtained from that test, which is what they are relying on to charge or fine you, is inadmissible and, therefore, they actually have no lawful case against you!

The other issue is that testing your breath to fine or charge you with having an excessive Blood Alcohol Content (BAC) is also flawed. As this website explains – https://www.bactrack.com/blogs/expert-center/35043461-three-types-of-bac-testing – there are 3 ways of testing your blood alcohol content and breath testing is not as accurate as actual blood testing and is yet another reason why breathalysers are not as accurate as the police claim they are because depending on many different factors, testing your breath may have little correlation to your actual BAC.

As with roadside breath testing though, there are numerous issues with the accuracy of the current system of drug testing procedures as well, as this article explains – https://sydney.edu.au/news-opinion/news/2019/09/12/study-casts-doubt-on-accuracy-of-mobile-drug-testing-devices-.html

It is interesting to note that the study showed that the current devices being used gave both false positive results and false negative results which clearly indicates that better systems need to be implemented and the current strategies need to be scrapped because they are clearly not accurate and continued use of them would significantly undermine public confidence in this type of enforcement.

Once again, we strongly believe in removing drunk and drug affected drivers from our roads but the ‘authorities’ need to implement systems and strategies that are far more accurate than the ones currently being used that are incorrectly and unjustly fining innocent motorists.

 

– Some good news to finish off

As we try to do in each update now, wherever possible, we want to finish of this one with some positive news.

This time, it comes from Victoria, where a single driver has taken on an entire council over unjust and unlawful parking fines and, not only had his own fine dismissed but is now working on having all similar fines dismissed/withdrawn as well, and has, so far, managed to get the council to stop issuing fines at that location!

And here’s one from a Member who received an unjust ‘illegal U-turn’ fine and had that dismissed after taking it to court.

Hi Guys,

Here’s my testimonial in a nutshell, I’ve tried to simplify as much as possible.

The charge was for doing a U turn at an intersection at traffic lights.

As soon as it began, I enquired as to where the 2nd magistrate was as I was requesting a chapter 3 court. (I explained High court ruling forge vs ASIC etc.) The judge looking annoyed and perplexed, tried to say that he was a chapter 3, to which I replied, “If so, I’m simply asking where the 2nd magistrate is etc or I do not give consent nor jurisdiction to the court.”

The judge certainly didn’t seem impressed by this. After about 10minutes of back and forth questions about this, at that point I felt it was necessary to also quote the “imperials acts act” innocent until proven guilty etc. The judge just smirked and shook his head at this.

When the police prosecutor came to the stand he Said one of his witnesses couldn’t make it due to injury I believe and as the trial had been adjourned a number of times before he was “happy” to have it dismissed. 

The judge asked a number of times whether the prosecution was sure about this to which the prosecution just reaffirmed. I was also asked by the judge whether I was a “lawyer or law student” and “how did I come across my information” to which I replied I wasn’t a lawyer nor student and that it was my own “personal” research, and also that I did not have to evaluate anymore on this.

At this point the judge dismissed the case and impolitely told me to “go away”

And, finally, there’s this very detailed e-mail form a Member who managed to use our strategies to drag out a matter so long that they admitted they had exceeded the Statute of Limitations and had to withdraw the fine because they couldn’t legally proceed with prosecuting it!

Dear Aussie Speeding Fines

On 18 Feb 2019 I was driving past a speed camera in ACT where it allegedly claimed I was 8km over the limit, ie 68 in a 60km zone. The fine was $292. I very much doubted that I had reached that speed between the lights, as I was about to turn into an adjoining road. I remembered that drive clearly as I was actually attending an important meeting that day.

I received a notice in the mail in March and then I immediately purchased your information.

9 March 2019 – My first step was to write an email asking for leniency.

14 March 2019 – received a reply stating that “In regards to withdrawing your application based on a good driving record. You will need to supply a copy of your licence history from NSW showing no traffic infringements within the last 5 years as you haven’t held an ACT licence for 5 years.” I did not respond as I had paid a low level fine in 2018 in NSW – at that time not knowing the procedures.

18 April 2019 – I emailed an application for extension of time – it was a PDF document, but little to my knowledge it did not save the fields.

24 April 2019 – received a reply “Unfortunately the application form has come through blank. Please complete and resubmit so we may further assist you, or as an alternative you can provide the requested information within the body of an email.”

3 May 2019 – received a reminder notice with a due date of 31 May 2019. Fine now $326.

30 May 2019 – applied for extension of time of 60 days (I could nominate a time on the form) with accompanying email stating “I have previously had trouble attaching the Digital version of this Application. I have therefore had to print, fill it out manually and scan it.” On the paper form I stated I was “Seeking legal advice from barrister”  to dispute the infringement notice, as the reason.

6 June 2019 – received a ‘Notice of Suspension’ around 11 June 2019 – allegedly suspending my right to drive in the ACT. As I had asked for an extension that was granted I chose to ignore this letter and continue driving in the ACT.

11 June 2019 – email received from a ‘personal’ email, granted 60 day extension of time until 12 August 2019.

9 Aug 2019 – I applied for a dispute online stating “I want the matter to be heard in court”.

9 Oct 2019 – received email letter stating “I refer to the above traffic infringement notice you disputed with this office. The Road Transport Authority must register disputed traffic infringement notices with the ACT Magistrates Court within a statutory time period. This period has lapsed on this occasion and as such the infringement has been withdrawn.
The Access Canberra Infringement Office now considers the matter finalised. “

The latest revenue raising insanity, plus some great victories!

Yes, yes, we know – it’s been ages since we last sent out an e-mail update! We have a ton of things going on in the background and we’re essentially keeping these to bi-monthly updates now so as not to ‘bombard’ people with information.

Most people nowadays receive a barrage of e-mails on a daily basis so we are committed to keeping our updates regular, with timely information but not so as to overwhelm people either.

We know that many of you eagerly await these e-mail updates so you can arm yourselves with the information that you need to protect yourself against the latest revenue raising madness so we know you will enjoy this update because that’s exactly what we’re focussing on this month.

So, without further ado, let’s get straight into it …

– Extreme privacy concerns

We usually start each update with the latest revenue raising tactics because that is what is of greatest concern to most motorists. However, in this month’s update, there is an even greater concern than the on-going blatant revenue raising – it’s all about data collection and breach of privacy.

As our first article explains – https://www.whichcar.com.au/car-news/smart-street-lights-could-be-turned-into-speed-cameras – there is now a proposal to turn every street lamppost into a speed camera by tracking cars!

There is, of course, no surprise that the article kicks off talking about the usual government propaganda – claiming this will improve road safety and driver convenience – but it does actually go onto address the real issue, that they could be invasively used to act as a ‘blanket of speed cameras’.

Anyone who is yet to read George Orwell’s “1984” should rush out and grab a copy now because Big Brother is well and truly here. As the article goes onto explain, Australia is a prime candidate for this kind of technology because we simply don’t have the data protection laws that they do in Europe so there is, essentially, no concept of true privacy here at all anymore.

And, speaking of data protection laws and breach of privacy, this article – https://www.9news.com.au/national/sydney-traffic-cameras-privacy-concerns-high-resolution-images-technology-crime-news-nsw-australia/c57a2133-3626-42f3-bc75-32969bfcabd2 – explains how Sydney is now operating a world-first traffic camera system that collects data on every driver that passes through, whether those motorists have done anything ‘wrong’ or not.

Of course, the government that approved them claims that they are there for ‘safety purposes’ but those claimed safety benefits come at the absolute, guaranteed cost of motorist’s privacy, which is totally unacceptable.

The article goes on to explain just how much data is being collected from every motorist that passes by these cameras, including: photos of their faces, travelling companions and number plates. Unless you have specifically consented to the government collecting all of that information from you then it has been denied and we must act collectively – by writing to our local MPs – to explain that we will simply not tolerate this blatant breach of our privacy.

As always, Sydney is simply being used a ‘test case’ and, depending on how many – or how few – people complain, rally, express their lack of consent etc. then the same systems will very quickly be rolled out around the rest of the country.

Anyone who continues to bleat the government mantra that, “If you haven’t done anything wrong then you should have nothing to hide” should read up on just how much data has been stolen from supposedly ‘secure servers’ by hackers in just the last year alone.

Insane new revenue raising tactics

As we have explained many times before, the various State governments around country collectively earn more than two billion dollars a year from traffic fines – raping and pillaging motorists of their hard earned money is now big business around the country.

In order to continue topping up their coffers though, they need to come up with ‘innovative’ ways of extracting more money from people and, as you will soon see, they are pulling out all the stops now and they are literally going for broke!

As this article details – https://www.whichcar.com.au/news/exhaust-noise-cameras-are-being-fitted-to-existing-speed-cameras – the government is now fitting exhaust ‘noise cameras’ to existing speed cameras in the UK.

The UK government isn’t as blatant as their Aussie counterparts so they, at least, have the courtesy not to claim that this latest revenue-raising push is about supposed ‘road safety’, they instead say it’s about reducing ‘excessive noise’. Now, this obviously begs the question of how the noise from a ‘modified exhaust’ on a 4 cylinder car, for example, compares to the noise from a truck exhaust but, hey, we’d hate to state the obvious!

You can bet your bottom dollar that if the trial is ‘successful’ in the UK – ie. They figure out they can issue a bunch of new fines as a result – then it will quickly be ‘adopted’ here in Australia as well.

And, right here in Oz, the government is now ‘cracking down’ on a myriad of insanely minor issues, in a blatant attempt to simply extort more money from innocent motorists. Things like hanging things from your rear vision mirror or putting stickers on your back window can land you a big fine because the police claim they could obscure a driver’s view. Now, yes, we’re sure that some people might put ridiculously large stickers on their windows or hang large objects from their mirrors but they are not the ones police are specifically targeting, they are now targeting anyone and everyone for any minor breach of this rule.

– Proof that none of the revenue raising will work

As the sections above clearly outline, the State governments continue to raise an insane amount of money under the false and misleading guise of ‘road safety’. However, as this article explains – https://www.abc.net.au/news/2019-08-01/australian-automobile-association-political-inaction-road-toll/11372234 – the continued focus on revenue raising is not what is going to actually improve the road toll, which, as we explained in our last update, continues to increase in many States around Australia.

The article is quite scathing and starts by pointing out that almost half of the ‘road safety’ targets set by the National Road Safety Strategy will not actually be met. It goes on to specifically state this is because of ‘political inaction’, which is ‘costing lives’.

It goes on further to clearly state that it is the ‘futility of the government’s current playbook on road safety’ that is the direct cause of the increasing road toll and the primary reason why the road safety targets are not being met.

It also spells out that one of the fundamental flaws in the government’s current strategy is that they “assume drivers will make errors and try and limit the damage, rather than address why those mistakes were being made in the first place.”

As the article details, the police are threatening to stop issuing fines and to clearly signal where speed cameras are, purely in a bid to increase their pay. Now, there is simply no way that the government would ever allow that to happen if those cameras, and their subsequent fines, really had any meaningful impact on road safety what-so-ever.

Now, we want to make it clear, we don’t have an issue with the police, or any other group of people, taking some sort of action to improve their working conditions or any of the other points that the police appear to be trying to make, but we are pointing out that this clearly shows that speeding fines are, quite clearly, there for nothing more than blatant revenue raising.

– Some really positive news

Thankfully, it’s not all ‘doom and gloom’ this update and, in fact, we have a number of really positive articles to share with you.

Firstly, as this 9 News story explains – https://www.youtube.com/watch?v=WAI6FhGaIms  – there is a new Google-owned app, called Wayz, that gives motorists real-time updates on speed camera locations.

Although the story is from Perth, the app is available for motorists all around the country and, in fact, is being used in many other countries around the world as well. It’s free to download and, as the news story explains, the more people that start using it, the more up-to-date and accurate the information will be so we urge all our members and subscribers to download a copy of the app and to start using it.

One of our members, who has successfully challenged a number of fines, also sent us this article – https://motorbikewriter.com/challenge-lidar-speed-fines/ – which refers to a number of Supreme Court judgements that motorists can use to successfully challenge a range of speeding fines from Lidar devices (laser guns).

As we explain in our e-book, and as is confirmed in the article, given that these are Supreme Court rulings, they can be relied upon in any State or Territory so they are extremely helpful. These rulings, of course, back up exactly what we cover in our e-book, and that is that the testing and calibration certificates for the devices cannot be relied upon as evidence and, again, this is basic information that many Aussie motorists simply aren’t aware of.

We also received another exciting article from the US – https://www.activistpost.com/2019/09/victory-court-rules-govt-must-refund-millions-in-red-light-camera-fines.html – where the courts ruled there that the city of New Orleans had to refund millions of dollars in Unconstitutional red light camera fines.

Although this article is obviously from the US, we would argue that similar principles apply here in Australia as well and, as always, the way to use this would be to simply ask the Prosecution to explain how, or why, those same legal principles do not apply here – if they can’t, then it must be accepted that they do.

At the end of the day, the legal principle of ‘proper due process’ applies equally here in Australia, as it does in the US and the UK and the Prosecution and/or Court would need to show otherwise, which they obviously can’t do.

And, finally, there’s this article from WA – https://thewest.com.au/news/albany-advertiser/woman-wins-speeding-court-case-ng-b881303028z – detailing how an Albany woman stuck to her guns, represented herself, and had her speeding fine thrown out in court.

People often write to us complaining that there’s just ‘no use’ trying to fight fines anymore because you’ll only end up in court where you ‘can’t win’, but this article shows – as do our numerous testimonials in the section further below – that that is simply not true.

It is important to note the Magistrate’s ruling that, A) the police could not prove their case beyond a reasonable doubt, which, as we explain in our e-book, is what they need to do – you do not need to ‘prove’ that you were innocent, as they often try and tell people, and B) that she also questioned the accuracy of the photos evidence, which is, of course, yet another point that we cover, in detail, in our e-book.

As always, we urge all motorists to challenge every unjust and unlawful fine that they receive and we hope these articles inspire you to do so.

Firstly, don’t be daft, don’t get your car towed. Be sure to read the signs.

I thought I knew the times, and didn’t check, and my car was towed.  Thus a long walk and train ride and long walk to the depot. Lots of  sorry people hanging around outside, stressed about the huge amount they need to pay – people that didn’t have my skills. I felt bad for them.

What do you call it, when someone approaches someone elses belongings when they are absent, steals them,  and then demands a ransom for the return of those goods?

Is that theft and extortion? 

Brisbane City Council did this. At the Depot, my plan was to record using my phone, and ask the attendants a bunch of questions, and when they couldn’t answer them 3 times, pursuant to Contract/ Equity law it means they have defaulted and I can answer for them, and hold them commercially liable as surety for the Trustee. I commenced this but it was SO hot and I just couldn’t get a focused cohesive dialogue.

I wasn’t going to provide my licence when they asked, and then, as if I somehow owed them something, they said not providing my ID meant they would call the police, who were presumably next door – there was a big sign saying Queensland Police. Obviously in cahoots with this operation.  My brain was ticking over with how council, a towing company, and the state police, could legally all function together in a way that gave them the right to steal my stuff and charge me to get it back, and as it obviously wasn’t legal, how I could use that against them.

I was stressed and exhausted and knew I didn’t have the zen calm I needed to question the police and assert my rights, so I left, vowing to work out how to get my car back without paying.

The following is all I could think of.  I knew if i paid cash, the money was gone. The next day I paid to collect car using my debit card, and selected ‘credit’ on the EFTPOS  so I had Mastercard/Visa card Buyer Protection.  (I had looked this up online).  Note, this is not a credit card, just a visa or mastercard DEBIT card, regular ATM card.

I then made a dispute claim for, misreprentation of seller or whatever the catgeory was, through my bank who issued the card.   The process was, I first had to contact the ‘seller’ and negotiate. If that failed, file a claim statement with the bank.  Seller would get to read this also. Bank would refund money. If the seller didn’t respond adequately ie dispute claim in 21 days, you kept the money.

I contacted the towing people. The receptionist did a lot of stressed frantic gesturing when I said I was calling to dispute a claim, and the person she put me through to was a cop, I swear. Their bully attitude, zero creativity or sense of humour, attempts to intimidate. The call also sounded like it was being recorded by about 5 different lines, lots of crazy echoes and reverb.

One of my takes on it, was the Council signage and by-laws applies to employees of the council, and council was illegally misrepresenting by claiming I was an employee, and applying its laws to me. The cop tried to twist this around by claiming I was impersonating a council employee, and wasn’t that illegal etc.  BE CAREFUL WHAT YOU SAY.

Don’t take the bait, say as little as possible. In retrospect I really shouldn’t have gotten into any debate,  but I didn’t realise I was going to be put onto a cop. I ended the call

declaring the non sequitir  ‘All Rights Reserved’ so anything in the call couldn’t be used against me.

I lodged the claim, being able to say I’d tried, and referencing some of the conversation and how the representative for towing company had failed to substantiate they weren’t acting illegally.

I structured the claim like a Notice, with the title ‘notice to agent is notice to principal, notice to principal is notice to agent’   with a series of questions, all alluding to the illegality of stealing my car and holding it to ransom and claiming they had legal authority to do so, and how the towing employees and the council could all be charged,  and sued, for their conduct.

CHECK ALL DOCUMENTATION

The release form from the towing company had a ‘damages’ section, so they could indicate if the car was damaged and whereabouts, to prove that no damage occured while it was held to ransom.  Well,  always have faith in award wage slaves not  caring enough to do their job properly.

This damaged report section was blank. Thus, the damage my car ALREADY had prior to towing,  wasn’t indicated on the report. In the claim notice, I pointed out my car was NOW  damaged and according to the form it wasn’t damaged before

On the towing release form, I knew the unstanted claim is that you waive all your rights once you pay and sign the form. Thus I  signed  ‘under duress and threat of menace,  all rights reserved’ (always sign these kinds of forms this way. Write this FIRST before you sign your name – police have been known to snatch the form away before you get to sign your name.)

And, make sure that sentence crosses over your signature so it can’t be removed with a photocopy or cut off somehow.

I was able to indicate this manner of signing on the claim notice – thus ensuring my rights were intact.  I also mentioned their terms and conditions were not made transparent to me when signing, certainly not provided with my copy of the release form, so if there was any contract, it was void anyway.  This is all so elementary.

As you can probably guess they didn’t dispute my claim and I kept my money.  A fair bit of work and stress but a positive victory and I cost them money in the process.  Every little win makes a difference for those who come after you.  The only thing I have that people don’t always seem to is, is I don’t accept shit as truth when its presented to me and I put the pressure back on those who try to compel performance from me by assuming I will accept their shit masquearding as truth.  For example ‘we are allowed to take your car and make you pay for it’ or  ‘we can charge you to travel over this road, that actually belongs to you more than it does us’

The one thing I failed to do, was not to certify this victory in some way in order to establish a precedent of sorts, for myself and others to use in future.  I wasn’t sure how. Maybe someone reading this can achieve this

More revenue raising madness but some good ideas too!

– Intro

We have an interesting collection of articles in this e-mail update, and some of them are a little difficult to bundle them into specific sections like we usually do but, we’ll do our best.

There’s some really great information in this month’s update so, as always, make yourself comfortable and let’s get straight into it …

– The revenue raising madness continues

Many of you will recall that we reported in our last e-mail update about the South Australian government blatantly admitted that they were increasing fines to try and claw back “lost GST revenue”. Well, it appears as though the Victorian Government got wind of that and thought it was a great idea and followed suit – even though they didn’t have any ‘lost revenue to claw back’, they just figured it would be a great way to make more money!

As this article details – https://7news.com.au/news/victorian-budgets-to-be-hit-with-increases-to-road-tolls-fees-and-fines-c-194128.amp?__twitter_impression=true – Citylink tolls are set to rise by 4.25% every year for the next decade! And, on top of that “all Victorian government fines, fees and charges went up by 2.5 per cent on Monday – almost twice the inflation rate.”

Obviously, the government has done this because they have categorically proven that their existing ‘road safety initiatives’ have drastically reduced the road toll and that clearly justifies those increases in fines because those ‘deterrents’ are working so effectively.

Oh, whoops, hang on, no, that’s not what’s happened at all. In fact, it’s actually completely the opposite! As the TAC website shows – https://www.tac.vic.gov.au/road-safety/statistics/lives-lost-year-to-date – the road toll in Victoria has actually increased by 57.7%!!!!

If that doesn’t clearly prove that all these insane fines are just about pure revenue raising, we really don’t know what will.

And, of course, it’s not just Victorian and South Australian motorists that are getting stung with blatant revenue raising fines, it’s happening in NSW as well. Check out this story – https://www.dailymail.co.uk/news/article-7144153/amp/Driver-fumes-shes-handed-337-fine-little-known-offence.html?__twitter_impression=true – where a driver was given a $337 fine for her passenger using her phone! Yes, you read that correctly, she was fined, not because she was using a mobile phone whilst driving – which, we agree, could, indeed, be dangerous – but, instead, because her passenger was on the phone and they claimed that she might get ‘distracted’ by that!

Are you serious??? What about the constantly changing speed limits, overhead signs, barrage of advertising on billboards etc. Those things can be distracting, not your passenger using their mobile phone. Besides which, a phone is neither a ‘TV nor a VDU’ – as stated on the fine – we certainly hope the lady concerned is going to fight this absurd fine.

And, that fine was issued just a month after another motorist was also hit with a $337 fine while his passenger was using a laptop.  Talk about desperate for revenue!

These fines, of, course, are in addition to the insane number of other traffic fines being handed out by the NSW government each month. As this 7 news report details – https://www.facebook.com/watch/?v=3040478989311840 – the equivalent of “51 fines for every hour of every day” are being issued on NSW roads.

Good old Bernard Carlton spouts the usual rubbish of ‘stay under the limit and you’ll avoid the fine’, which we have proven so many times, over the past 12 years, is absolutely not the case, because incorrect, unjust and unlawful fines are still issued every single day.

The report goes onto to explain that over $20 million worth of fines were issued just in May this year, consisting of 37,000 speed camera fines and 13,000 red light camera fines. As we have said til we’re blue in the face, if that many motorists are doing the ‘wrong thing’ that would cause them to receive a fine then, clearly, the government’s definition of ‘wrong’ needs to be significantly adjusted.

In fact, in just 5 years, NSW motorists have been fined over $1.1 billion and yet, despite all of that wonderful revenue flowing into the government coffers, as this website shows – https://roadsafety.transport.nsw.gov.au/statistics/index.html – the Year-to-Date road toll in NSW has, like Victoria, continued to increase!

The reporter even blatantly admits that, “after issuing more than 366,000 penalty notices last financial year, totalling more $100 million, it has become a staple form of government revenue that’s guaranteed to rise” – yet how can that be if, as they claimed earlier in the report, that the prevalence of cameras and fines has caused people to slow down and ‘save lives’. Either the cameras work, as they claim, and slow people down, which means that fewer fines would be issued each year or, they don’t and its just blatant revenue raising – it can’t physically be both!

The biggest concern, of course, is that they continue to get away with this insanity and this article – https://www.illawarramercury.com.au/story/6219243/windang-road-speed-camera-still-stinging-hundreds-of-drivers/ – explains how easy it is. They simply drop the speed limit in a particular area, install a camera and then sit back and watch the money flow in as drivers get stung and just blindly ‘pay up’.

They admit that there’s been a 300% increase in the number of fines issued since the reduced speed limit took effect and also admit that there been “a huge surge in the monetary value of fines compared to the previous year” and go on further to admit that equates to “an almost tenfold increase on the $125,079 in fines from the camera the year before” – all while the road toll continues to increase!

Hopefully, it is now crystal clear that these fines exist purely as a revenue raising tool for the various governments and, even more hopefully, you are now fired up to fight back and do something about it. How to fix the rising road toll

As we noted in the section above, the road toll continues to rise in most States around the country but it is absolutely horrendous in Victoria – where, incidentally, they have the lowest tolerances for speeding fines and issue more fines than anywhere else.

In fact, it’s so bad that, as this article explains – https://www.theflindersnews.com.au/story/6247792/new-road-safety-office-to-tackle-vic-toll/?fbclid=IwAR2CWO-8CFvNO6KdWla8ikndG1baCZ7QlIg-yf3md3vSf_WAyqpi4BbmRj0 – they have actually set up a new office to try and combat the huge increase in the road toll.

Of course, we all know that new office will achieve nothing, other than to raise more revenue for the government, because they refuse to look at realistic ideas, that will genuinely reduce the road toll – but won’t make them any money – such as the ones we have had detailed on our Vision for the Future page – https://aussiespeedingfines.com/about-asf/vision-for-the-future/ – for over a decade now.

Instead of taking on board and embracing some of these ideas, they are completely ignoring them, as this articles explains – https://www.whichcar.com.au/car-news/driver-training-solution-to-road-toll-greg-murphy

Now, although the article is from New Zealand, quite obviously, the strategy of improving driver training – that acclaimed racing driver, Greg Murphy is suggesting – is equally applicable ‘across the ditch’, and here in Australia.

It’s interesting that, one the one hand, in New Zealand they openly admit that “car crashes are inevitable and impossible to prevent”, but, on the other hand, appear to be working towards a completely unrealistic and impossible “Vision Zero” target, much like the blatantly stupid “Towards Zero” motto that the TAC uses in Victoria – where, we remind you, the road toll has increased by almost 60% since last year!!!

As the article explains, Sweden has a similarly unrealistic target but, and it’s a big but, they are actually implementing strategies – like much better driver training and education before a licence is given out – that is clearly showing up in their statistics. We simply can’t understand how, if the author of this article can refer to the situation in Sweden, that the New Zealand government – and our own governments here – can’t see the whole story and take appropriate action to replicate the results here.

At least on the other side of the country, in Western Australia, someone’s got a brain and realises that actually increasing the speed limit will actually reduce the road toll. As this article covers – https://thewest.com.au/news/kalgoorlie-miner/raise-speed-limit-scott-ng-b881230604z – WA State MP, Robin Scott, believes that speed limits on open roads should be increase to 130km/h, which makes absolute sense and aligns perfectly with what we have been teach people for the past 12 years.

Modern cars can easily handle those speeds, the majority of roads can be safely driven on at that speed – and, those that can’t should be fixed with the extraordinary amount of revenue they are raising. The issue is that, at a mere 100 km/h, people are falling asleep at the wheel and, therefore, people would be far safer, on those roads, driving at higher speeds. After all, when did you last hear of a driver falling asleep on an Autobahn in Germany?

Of course, the so-called ‘Road safety Council’ doesn’t understand any of this and, instead, wants to reduce speed limits by 10km/h so people fall asleep quicker, get distracted more easily and have even more accidents – seriously, how stupid can you get? Yes, yes, we know, that was a stupid question to ask, sorry, our bad.

Mr Scott also mirrored our sentiments, and Greg Murphy’s, by again stating that “road maintenance and driver education were key to slashing road fatalities.”

– Parking fine madness

We received two ‘interesting’ articles on parking fines this month that got our attention.

The first was from a woman who was issued with a $263 parking fine when the sign she parked near had clearly been altered with liquid paper and, despite proving that, the council still refused to withdraw the fine. The fact that they acknowledged that the sign had been graffitied but still refused to withdraw the fine shows how completely belligerent they have become because they know that most people don’t want to go to court and that’s exactly how they keep getting away with this insanity.

People need to spend some time read through our numerous testimonials pages – https://aussiespeedingfines.com/testimonials/ – so that they can understand that, A) just because you challenge a fine, it does not mean that you will end up in court and B) even if you do end up in court, it’s not as big a deal as most people think it is.

This is a perfect example of a fine that should be fought in court and the council should be hit with costs for wasting this persons’ valuable time, and the more people that do that, the quicker they will get the message and stop harassing innocent motorists and pursuing such ridiculous fines.

Of course, it’s not just the Glen Eira council doing this, it happens all over Australia, it just so happens that this particular mother put it up on social media and got a lot of support from other parents, which is great. – Some other interesting articles

Our final two articles don’t really fit into a specific category so we’re including them here because they are still important for people to know about.

The first is an interesting industry article sent through by one of our members, in relation to a truck driver who was fired from his job for speeding. This article – https://www.employmentlawhandbook.com.au/gps-evidence-was-insufficient-to-dismiss-speeding-driver-fwc/ – raises some important points about the ‘degree’ of speeding and the ‘length of time’ speeding.

The Fair Work Commission ultimately awarded the man $17,000 after saying he was, indeed, unfairly dismissed. Vice President Hatcher stated that “Variations of up to 5 km/h from one second to the next are common” and went on to say that “This leads me to conclude that the data should be analysed on the basis that, in order to ascertain whether there has been any ‘speeding’ in the conventionally understood sense, it is necessary to identify a reasonable period over which the [vehicle] has travelled over the speed limit.”

We believe that these would be great points that you could add to your list of arguments in any future speeding case and you could refer to that ruling and ask the court to explain why those principles would apply in a Fair Work Hearing case but not in an actual ‘speeding’ case.

And, finally, there’s this disturbing article from WA – https://www.abc.net.au/news/2019-06-10/police-officer-in-fremantle-tasering-receives-suspended-sentence/11195678 – where a police officer has finally been held to account for tasering a man who was sitting in his car, with his seatbelt on.

As the article details, the officer tasered a motorist, who was in his car, with his seatbelt fitted and, therefore, clearly posed no physical risk to the officer at all, during a routine roadside stop.

Quite unsurprisingly, three separate ‘internal investigations’ – ie. Police investigating themselves to confirm that they have, of course, done nothing wrong – cleared the officer of any wrong-doing but, thankfully, the matter ended up in court, where the officer got what he ultimately deserved.

Whilst the motorist will have to live with what happened to him, it is another brilliant example of everyday Aussies fighting back against out of control police and their corrupt ‘internal investigations’ and sending a loud and clear message that this kind of behaviour will simply not be tolerated.

Received an email stating that after reading my annulment, they want to challenge me in court.

Received ANOTHER email from them which I am more than happy to leave in the comments 😊

I want people who are sceptical about our constitutional rights, as well as people who have no faith in beating the corrupt system that we live in, to read this and realise that we still have a chance. There were people who said to ‘just pay the fine’ and yet here I am having successfully beaten the system while using their own system against them.

The latest important news from around the country!

– Intro

Well, it’s been another couple of busy months since our last e-mail update and, as we enter another busy ‘revenue-raising’ period this weekend – with most States having a long weekend as part of the Queen’s Birthday holiday – the ‘policy enforcers’ will be out raising as much as they can, as this is the last ‘long weekend’ until October for most States.

Therefore, we believe our information is very timely this month so, as always, make yourself comfortable and let’s get straight into it …

– Victoria, completely out of control

As we have explained a number of times before over the past 12 years that we have been operating, everyone believes that their State or Territory is the worst place for fines but, as we keep proving, time and time again, Victoria is, by far and away, the absolute worst place for fines.

Yes, as you will see from the next section below, the South Australian government have, indeed, recently raised their speeding fines to become some of the highest in the country but for sheer number of fines and for how completely out of control the system of fines is, Victoria is the clear winner.

As most Victorian motorists are well aware, there were so many people successfully using the Aussie Speeding Fines system – https://aussiespeedingfines.com/about-asf/about-the-e-book/ – in Victoria that the government started by re-writing all their pro forma letters in a desperate, but entirely ineffective, attempt to respond to the number of people challenging their fines and, when that ultimately didn’t work, they changed their entire system of fines enforcement over to the new Fines Victoria system.

Well, the new system has been proven to be even worse than the system it was replacing and we have reported previously on how insanely backlogged the new system is, and it’s gone a step further now with the Victorian Ombudsman releasing a damning report, stating that the new system is “plagued with errors”.

A father who was sent fines for his dead son and a taxi driver who went without wages for a month are just some of the 600 complaints they received! And here is another story – https://www.3aw.com.au/mother-in-battle-with-fines-victoria-after-terrifying-car-theft/ – of a Victorian motorist who has been battling with Fines Victoria, when she should never have had to, after her car was stolen and racked up a number of fines.

This article – https://thenewspaper.com/news/66/6696.asp – goes into even greater detail on the mess in Victoria and specifically notes that “At least 397 motorists lost their right to drive because the state government bungled the handling of speed camera fines.”

It goes onto to clearly state that, “The impact of these issues should not be underestimated. People had their licenses wrongly suspended, or were treated as liable for substantial fines, when they had committed no offense.” There is even a link to the entire report at the bottom of that article, of you can access it here – https://thenewspaper.com/rlc/docs/2019/au-bogusfines.pdf

And, as you can see from this article – https://www.3aw.com.au/its-a-state-scandal-fines-victoria-still-hasnt-fixed-its-administrative-problems/ – despite their suggestion that it will all be ‘sorted’ by June, that is clearly not the case!

The system is in a complete shambles in Victoria and this is the perfect time for Victorian motorists to bombard the agency with letters challenging their fines. This will completely overload and overwhelm them and the Victorian system is right on the tipping point of being the first system in Australia to completely collapse – all we need to do is push that little bit harder and finish them off, once and for all.

Further proof that fines are just for revenue raising

As we referred to in the section above, the South Australian government have just increased a number of fines which, in and of itself, isn’t anything overly surprising but, as you will read in this article – https://indaily.com.au/news/local/2019/05/23/lucas-targets-speeding-motorists-as-gst-loss-clawed-back/ – they have blatantly stated that it’s because they are trying to recoup lost GST revenue!!!

Yes, you read that correctly, they’re not even trying to claim that fines are for ‘road safety’ anymore, they blatantly telling everyone that it’s purely about raising revenue. The Treasurer even goes so far as to openly state, “It’s no secret the state faces a significant $517 million shortfall in GST revenue in 2019-20 and it’s imperative we seek to plug that hole in a responsible way,”

How, exactly, is stinging innocent motorists – who have done nothing more than slightly exceed an arbitrarily set, and artificially reduced ‘speed limit’ – considered a ‘responsible way’ of plugging a hole that their own irresponsible spending created?????

Here is another article – https://www.abc.net.au/news/2019-05-23/sa-government-announces-fee-and-fine-increases/11142818 – outlining the same points but they spell it out even more specifically with the line, “Mr Lucas said the increase in various fees and charges make up about $79 million of a $500 million reduction in expected GST revenue.”

Thankfully, even the mainstream media is understanding that this is all blatant revenue raising and they are starting to ask some important questions, such as, “Should Australia scrap all ‘revenue raising’ red light cameras?”, as this article details – https://7news.com.au/news/crime/red-light-cameras-should-australia-follow-texas-suit-and-scrap-revenue-raisers-c-145000

This article obviously mirrors exactly what they decided in Texas, which, of course, is what wehave been pushing for, for the many years that we have had our Petition to Remove Cameras page up for – https://aussiespeedingfines.com/about-asf/petition-to-remove-cameras/

– Problems in NSW

And, incorrect and inaccurate speed cameras strike in NSW as well, where, as this news story explains – https://www.facebook.com/watch/?v=374865336399337 – a major issue has been uncovered on a Sydney speed camera that could cause thousands of motorists to receive a refund on incorrect speeding fines that they’ve paid, after  Holden Astra was supposedly ‘detected’ doing 235km/h!!!

The RMS, of course, claims it was a ‘one off’ but, as we have explained for years now, speed cameras generally get it wrong and only occasionally get it right so this is clearly not a ‘one off at all.

This fact is clearly confirmed when the reporter asks the RMS representative twice if he can “guarantee that no other drive has been unfairly targeted by the camera” and he fails to answer!

The next guy that comes on says that he “hopes” that the cameras are being “kept up to the proper standards” – sorry, but that’s simply not good enough!!! Either the cameras are 100% accurate, all the time or they’re not, in which case, they should be switched off!

As we have said more times than we can count, if the fixed camera system in NSW alone is bringing in $200 million in revenue then there is clearly an issue with the camera system or with what the government’s definition of ‘wrong’ is!

It’s interesting that there was no ‘speed camera’ that stopped this absolutely moronic police officer – https://7news.com.au/news/crime/dashcam-captures-moment-police-car-is-smashed-while-trying-to-perform-highway-u-turn-c-80888 – from attempting to do a U-turn in front of a 4WD, injuring the occupants of the vehicle, in NSW, during a double demerit point long weekend.

It seems as all those ‘road safety’ cameras and ‘road safety’ initiatives can fix stupid after all.

– There is some good news though

Thankfully, it’s not all bad news this update, in fact, the really great news is that people are truly starting to wake up to the truth about these ridiculous revenue raising systems and are actually fighting back.

As this article details – https://www.msn.com/en-au/news/australia/from-a-tradie-fined-dollar420-for-having-a-witches-hat-in-his-ute-to-parents-slugged-dollar198-for-their-dead-son-australian-drivers-demand-an-end-to-pure-fundraising-penalties/ar-BBVM5bw – people right around the country are getting fed up with the current system of blatant revenue raising and they are starting to fight back.

The article mentions a number of the stories that we touched on in the sections above, as well as numerous other ridiculous, and clearly unjust, fines that have been issued to motorists all around the country. The great news is that those motorists are not just ‘rolling over’ and ‘paying up’, they are fighting back!

One of the important facts/figures to take note of is the $3.5 to $5 billion dollars a year that is currently being raised via these unjust and unlawful fines around the country – if that’s not reason enough to fight back against every fine you receive, we don’t know what is.

Perhaps the fact that they openly tell you that they will fine you for beeping your horn or waving goodbye will be the final straw that makes people realise ‘enough is enough’! Or, maybe, it will be when you realise that you can now get fined for trying to do the ‘right thing’ – by sleeping in your car rather than driving home drunk.

Some very exciting information in this month’s update!

– Speed limited cars are coming

 

Most people we know have – usually at school – read the book “1984” by George Orwell. Many people already believe that “Big Brother” is already well and truly upon us but, for those who have any doubts, we’re about to get one step closer.

 

As this article – https://www.dailymail.co.uk/money/cars/article-6851299/All-new-cars-fitted-mandatory-speed-limiters-2022-shock-EU-rules.html – details, the EU wants to make it mandatory that all new cars produced by 2022 be fitted with speed limiters that stop you from being able to exceed the posted speed limit, no matter what.

 

Now, we have reported previously on the consistent reduction of speed limits on most major roads around the country – highways that used to be ‘safe’ to drive on at 90 or 100 have been lowered to 80 km/h. Secondary roads that used to be 70 or 80 have been reduced to 60km/h zones and the like. We’re sure that pretty much everyone reading this has seen a number of speed limits reduced in their own areas – we haven’t heard any reports of any roads having their speed limits increased though!

 

This is clearly all about control and that’s why this new move is seriously concerning.

 

The article includes comments from the AA President who is concerned that people will just drive at the speed limit no matter what the conditions – even when it might not be safe to do so – but does not in any way address the fact that speed limits have been artificially reduced and have no basis in reality, being referred to as a true speed ‘limit’ anymore. This is easily proven by the fact that so many people still exceed the speed limit on a daily basis and are never involved in any kind of an accident or incident. If the current speed ‘limits’ truly were limits then there would be complete carnage on our roads every day, which is clearly not the case.

 

The whole concept of ‘speed limits’ is to control people’s freedom of movement and that is a huge step towards complete control by ‘Big Brother’.

 

And, don’t think that just because this article is about the EU that we will escape this insanity here in Australia! As this article confirms – https://www.whichcar.com.au/news/speed-limiters-are-coming-to-australia – the exact same technology and legislative requirements are coming to Australia, and within the same time frames.

 

It’s interesting that the article refers to current speedometers as being a ‘hurdle’ to this new technology. As we have previously explained, if “speed” really was the “biggest killer on our roads” – as the authorities claim – then surely something as simple as an annual speedo check (or least every time a roadworthy is completed) would be mandatory so people knew, with far greater certainty, the speed that they were actually doing. It is, of course, not mandatory, because the powers-that-be don’t actually want people to know what speed they are doing because they would miss out on hundreds of millions of dollars worth of revenue if they did!

 

The truth about ‘speed’

 

As we detailed in the section above, the push towards cars that can actually limit the speed a motorist is traveling at is a very serious issue for numerous reasons. The biggest issue, of course, is that the entire premise for them – to supposedly improve ‘road safety’ – is fundamentally flawed.

 

As we have detailed on our website for some 12 years now – https://aussiespeedingfines.com/downloads/Crash_Statistics.xls – speed is only “a” factor – not even “the” factor – in just 5% of accidents! So, why the big push to reduce speed and reduce speeding???

 

This article– https://driving.ca/volvo/features/feature-story/motor-mouth-speed-versus-safety-is-faster-always-worse – was released after the EU announcement that we referred to in the previous section and it asks a very powerful question – “If speed really does kill, why is driving so much safer in Germany?” It is a very balanced, ‘middle of the road article’ but well worth a read because, even from that position, it makes it pretty clear what speed limits are really all about.

 

Then, there are articles like this one – https://thewest.com.au/news/traffic/speed-up-to-save-lives-says-f1-great-mark-webber-ng-b881137994z – where former F1 racing driver, Mark Webber explains why raising the speed limits could, in fact, make our roads safer and save lives. This, of course, mirrors exactly what we have been telling our Members for the last 12 years!

 

In fact, he explains, almost word-for-word, the same thing that we do – if the speed limits weren’t so low, people wouldn’t try and use their mobile phones and, of course, the faster you drive, the more you concentrate – these are the things that will save lives on our roads, not just constantly reducing the speed limits.

 

The remainder of the article confirms what we said earlier, that there has been a systematic reduction in speed limits across many major roads, purely in order to raise more revenue for the government.

What the governments should be focussing more on is some of the true road safety initiatives that we have had outlined on our Vision for the Future page – https://aussiespeedingfines.com/about-asf/vision-for-the-future/ – for many years now.

 

People need to be better educated when it comes to road safety and far more pro-active about the condition of their vehicles. If you look towards the end of the “Benefits of TPMS” section on this page – https://en.wikipedia.org/wiki/Tire-pressure_monitoring_system – you will see that it states that; The French Sécurité Routière, a road safety organization, estimates that 9% of all road accidents involving fatalities are attributable to tire under-inflation, and the German DEKRA, a product safety organization, estimated that 41% of accidents with physical injuries are linked to tire problems.

 

Given those statistics, you would be far better checking your tyre pressure every minute rather than your speedo!!!

 

– QLD fines hit an all-time high

 

Clearly, the QLD government is well and truly ‘hooked’ on all the revenue they are raising from unjust and unlawful fines and have absolutely no interest in true ‘road safety’ initiatives at all.

 

As this article details – https://www.abc.net.au/news/2019-03-20/queensland-red-light-camera-fines-revenue/10912752 – the QLD government is expected to raise almost half a billion dollars from fine revenue in the coming year. Again, if ‘speed’ really did ‘kill’ then with that number of people speeding, surely, half the state should be dead by now!!!

 

Of course, there’s the usual completely BS statement by the Department of Transport and Main Roads claiming that “Ideally, no revenue would be collected…” yet they actually budget in those hundreds of millions of dollars each and every year! And, given that the amount they raise each year constantly increases, if they really wanted to “collect nothing” then, surely, they would see that what they are currently doing clearly isn’t working so they need to come up with a new system – after all, the definition of ‘insanity’ is doing the same thing again and again but expecting a different result!

 

Anyone with even half a brain can see that the entire system is about blatant revenue raising and control over motorists and nothing more!

 

– Councils in Victoria to refund millions in incorrect fines

 

And, to finish off with the media articles for this update, we have some great news out of Victoria, where a number of councils have been forced to refund millions of dollars worth of parking fines to motorists!

 

As this article details – https://www.theage.com.au/national/victoria/council-to-refund-2-6-million-in-parking-fines-20190304-p511p4.html – the Monash Council has had to refund $2.6 million worth of fines, which is fantastic news!

 

The council is obviously quick to chime in and handball the blame elsewhere but, at the end of the day, it really doesn’t matter who is to blame, the key is that those fines are being refunded. This is also a great message to pass onto those people who constantly bleat the media propaganda that “If you got a fine then you need to pay it because ‘the system’ is always right”. This shows, very clearly that the system is not always right at all and unjust and unlawful fines are issued, and incorrectly paid, every single day.

 

The part of this article that truly makes us shake our heads though is the line where the Monash Mayor says he is “conscious that ratepayers’ money would be spent on the $2.6 million in refunds.” How on earth does that work??? All they are doing is refunding the illegally gotten revenue they stole from motorists in the previous 10 years – it doesn’t have to come out of ratepayers’ money at all. If this doesn’t show you that all they care about is money, money, money, we really don’t know what will.

 

And, as this article explains – https://freelocalnews.com.au/surfcoasttimes/news/geelong-council-caught-up-in-parking-fine-trouble/ – the City of Greater Geelong is also caught up in the same issue, as is the City of Kingston.

Yes, we know that, once again, it seems like ‘forever’ since we last sent you an e-mail update – it was “last year” after all. We were obviously extremely busy helping motorists over the Christmas/New Year ‘revenue raising’ period and, once that all subsided a bit, we decided to take a month off to regroup and refocus for 2019.

This is actually our twelfth year of helping Aussie motorists defeat all manner of unjust and unlawful traffic fines and, we have to be honest, we felt a little ‘burnt out’ at the end of last year but, after our break, we are fired up and raring to go and we truly hope that this is the year that people finally get ‘fed up’ with all the blatant revenue raising and truly start ‘fighting back’.

The yellow vest movement

 

In our last e-mail update, we included a few articles on the actions of motorists in France, who were literally ‘taking out’ hundreds of speed cameras in France.

Well, since then, the “yellow vest’ movement has increased significantly and, as this article details – https://www.breitbart.com/europe/2019/01/10/macron-govt-yellow-vests-destroyed-60-percent-french-speed-cameras/ – French motorists have now destroyed 60% of the speed cameras in France, which is huge!

– Victorians are getting hammered once again

Okay, so back to traffic fines. Once again, it seems as though Victorian motorists are copping it worse than other States, which has pretty much been the case since we started this group.

This article – https://www.theage.com.au/national/victoria/melbourne-s-10-highest-earning-speed-camera-locations-20190113-p50r4i.html – details the top 10 highest earning speed cameras in Melbourne and almost boasts about how a brand new camera in the city has made it to the top of the list in “less than a year” – gee, that’s something to be so proud of, isn’t it!

The article even goes onto detail that “cameras throughout the city have generated $1,340,330 in fines ….” Almost $1.5 million in fines in a single city is outrageous! How about providing us with some data evidencing the top 10 ‘life-saving’ cameras in the city??? Oh wait, that’s right, that doesn’t exist, silly us!!!

Instead, the article talks about how 1 in 40 fines in Melbourne is issued in a 40km/h zone – surely, it must be obvious to even a blind man that the speed limit is clearly set too low if that many people are getting fines there!

If you actually pay attention to the breakdown of the top 10 sites, it becomes very telling, very quickly:

The sites listed as; 1, 3, 4, 6, 7, 9 and 10 out of the ‘top 10’ are all on freeways, where, clearly, the speed limit should be increased.

The sites listed as 2, 5, 8 out of the ‘top 10’ are all 40km/h zones where, again, the speed limit is, quite obviously, set too low.

So, all 10 sites are either in a 100km/h zone – which should, in reality, be, probably, 130km/h or so – and the remaining sites are in 40km/h zones, which should, probably, be 50 or 60km/h zones and, we would bet good money, they actually used to be, before they were arbitrarily and artificially reduced in order to simply raise more revenue!

And, as if that wasn’t bad enough for poor Victorian motorists, the Victoria Police have now launched their first ANPR (Automatic Number Plate Recognition) car – https://www.vicpolicenews.com.au/news/first-anpr-car-takes-to-the-road – to bully and harass motorists who don’t pay their ridiculous fines in these artificially speed limit reduced areas!

Now, of course, they claim that they are getting “unauthorised” drivers off the road but, again, anyone with even half a brain can look behind that claim and ask, “Why exactly are these drivers ‘un-authorised’?”

The first two points they make are suspended or disqualified drivers but, sure as eggs, most of those are as a result of failure to pay unjust and unlawful fines! Also, why are the vehicles “un-registered”?  Because VicRoads have removed registration stickers and someone is a day or two late in paying their rego!

Yes, of course, let’s get onto stolen cars and stolen number plates but, seriously, how many of the 5000 number plates they can scan per shift actually fall into that category?

And, please, can someone explain exactly which of the above categories makes someone a “dangerous” driver, as the police claim!

The worst thing is, that’s just one car – they’re about to roll out another 200 of them! Then, if all of that isn’t bad enough, you have this grub – https://au.news.yahoo.com/police-officer-one-man-war-073326903.html – working out of a country town in Victoria, who has personally issued almost $1.5 million worth of speeding fines!

The reporter boasts how everyone in town ‘likes’ him and how there hasn’t been a fatality in the town since he moved there yet they fail to mention this article – https://www.geelongadvertiser.com.au/news/geelong/motorcyclist-seriously-hurt-in-crash-at-inverleigh/news-story/45be70bbfd58e6d4f36681c9d06a44d8 – from just last year, which the good-for-nothing actions of Senior Constable Chris Reynolds did absolutely nothing prevent! Maybe he should, in fact, do what the reporter suggests towards the end of the video, and “focus on other crimes”!

– What about fines in other States

Obviously, it’s not just Victorian motorists who are getting screwed over, that’s happening right around the country.

In WA, they are turning back on their point-to-point speed cameras –https://www.watoday.com.au/national/western-australia/point-to-point-speed-cameras-switched-back-on-in-wa-s-south-west-20181220-p50nit.html – despite the fact that the concerns over inaccurate readings haven’t actually been addressed in any meaningful way. And, we’re sure it will come as absolutely no surprise to those of you reading this update, that they were turned back on just a day before the Christmas/New Year double demerit point period came into effect!

And, in NSW, drivers are fired up and demanding that the RMS send out reminders for their rego, as fines for supposed “un-registered” vehicles – which, as we explain in our e-book, is actually an incorrect charge because your vehicle is ‘registered’ for life, even if it’s ‘registered’ as a write off – have skyrocketed to $240 million!

As we have said in our updates before, the whole removal of registration labels is a complete scam and borders on entrapment! They claim it’s to ‘make life easier’ or to ‘save costs’ but how hard is to stick a plastic sticker on your windscreen once a year and how much can it really save?

They are still supposed to send out the reminder letters or e-mails, so what’s the real-worlddifference if they send out a piece of paper with a reminder notice or a piece of paper with a plastic sticker on it? Especially considering how much registrations have increased over the past few years, surely that increase has more than covered the additional cost of those small plastic stickers!

And, no matter what State or Territory of Australia you live in, as this article – https://www.news.com.au/technology/innovation/motoring/motoring-news/australian-fines-for-motoring-offences-among-worlds-most-expensive/news-story/4761ccd42450da57769f50d81af4b987 – details, you are paying some of the most expensive fines in the world.

In fact, on average, Aussie motorists are ranked as the sixth most expensive place on the planetto pay a traffic fine! If that’s not enough to make you want to challenge every unjust and unlawful fine you receive then we don’t know what is.

– Some sensible thoughts

Thankfully, not everyone has completely ‘lost the plot’ and, there are still some sensible articles being released in the mainstream media.

This article – https://www.msn.com/en-au/motoring/news/opinion-australia-needs-to-raise-driver-training-standards-not-lower-speed-limits/ar-BBRnjOe – for example, explains that, as we have been saying all along, there needs to be better driver training, rather than a reduction in speed limits, to make our roads safer.

We’re not going to get into all the individual points made in the article because they all make perfect sense and mirror what we have had on our Vision for the Future page – https://aussiespeedingfines.com/about-asf/vision-for-the-future/ – for over a decade now!

This is another great article – https://www.caradvice.com.au/724526/you-dont-know-what-you-dont-know/ – that covers the importance of driver training, especially, for example, in contrast to what they receive in places like Germany.

This quote, The various state governments have provided nothing but lip-service to the issue of driver-training, relying instead on ever more draconian penalties, outright propaganda, and discretion-free policing to deal with the road toll – which, despite the dire lamentations from the Police Media Unit, has remained static for the last decade or so.” really does sum it up perfectly.

As we have said many times before, there is simply no excuse for not completing an advanced, or defensive, driver training course and, really, with all the money our governments are raking in from unjust and unlawful fines, these should be subsidised by now anyway!

And, finally, there’s this article – https://metro.co.uk/2018/12/29/crashes-caused-drivers-going-slow-soar-third-8290610/ – from the UK, which talks about the fact that crashes caused by drivers going ‘too slow’ have soared by a third!

As the article clearly states – and as we have been saying for many years now – “driving like a snail can be as dangerous as driving like a cheetah’. The article even references a QLD study that “found that the risk of an accident can be increased by motorists who slow down when they use their mobile phone.”

So, all we need to do now is get the relevant people to realise that doing 100km/h on a freeway and 40km/h on a main road are clearly “too slow” and rectify the situation! That would, of course, knock out their top 10 ‘cash cow’ cameras so, the chances of that actually happening are slim to none unless we start forcing them to adhere to our Will by no longer paying their extortionate fines!

Well done on the whole concept of protecting our rights and providing access to the information for a very reasonable membership fee!

I joined a few months ago and used the e-book 3 step process to contest 2 speeding offences that were allegedly detected by the way of Lidar Speed Detection Devices that would have incurred a total of almost $1800 in fines and 11 Demerit Points.

I wasn’t travelling over the speed limit for either offence and didn’t want to waste money on having a lawyer represent me when I could explain the same defense in court myself with help from the e-book and a no bull shit approach!

Yesterday both offences were withdrawn by the Police!

Then there’s this detailed e-mail from a Member who knew his rights and avoided having a fine issued to him from the outset. This is why we explain that the best time to have our information is before you get a fine!

Hello everyone. I have a wonderful story to tell you.

I was traveling through the Rockbank Destruction Zone on the Western Highway Sunday 28 November. I was in the right lane when I heard sirens but could not see an emergency vehicle so I kept on driving. A few seconds later I heard the sirens again and looked again in my rearview mirror and saw flashing red and blue lights hidden behind the grill of a late model Commodore. So I pulled over and proceeded to pull out my licence from my wallet under the console lid. My windows phone was there also. But I did not pull out the phone.

2 female cops approached my window and complained because I only rolled the window down halfway. They asked for my licence, which I held against the window stating that I only had to produce the licence and not hand it over. The second cop snatched the licence and both went back to their car. I then got out my phone and started recording, placing the phone screen up in front of the shifter. About 1 minute later they return.

“Mr. Allen, could you roll your window all the way down so we can talk to you?’ I rolled it down about 3/4.

“Mr. Allen, do you know why we pulled you over?”

I continued looking sorrowful and downward at the floor.

“Mr. Allen, we caught you speeding. You were doing about 117 in a 90 zone. Is there a reason you were speeding so fast today?”

Still looking down I was. About 20 seconds later I replied, “No comment.”

“Ok, could you please drive slower the rest of the afternoon?”

Said I, “I will”.

They go back to the car. I look in my mirror as I don’t know what is going on. The driver motions me to leave, but I fidget and wait for them to leave first, then I go on my way.

Time of stop. Under 4 minutes. The video lasted 3 minutes plus the time beforehand. No fine, no warning, nothing.

Many thanks to CARR, ASF, and Know Your Rights groups, of which I am a member of all three groups, for the helpful advice which got me out of a fine and possible licence suspension. Also that I didn’t pull the phone out at first as I did not want them to give me a citation for phone use while driving. Another help was saying No comment. I also did not talk back, act rudely (though I wanted to tell them to f… off), and looking contrite all helped out. I also said as little as possible otherwise, and pointing out that I didn’t have to hand them my licence at the start led them to think it was not worthwhile to hand me an infringement notice.

I have been paying more attention to my speed since then. And I do feel victorious that I won in this instance.

And, finally, although this isn’t a ‘testimonial’, we thought it was worthy of including in our ‘feedback’ section because it raises an interesting point that people should be aware of and can definitely use in applicable cases.

Just a quick comment.  In court for a fine it is a criminal court.  When magistrates are asked if speeding is a criminal offence, not civil then they admit it is criminal. 

In the camera vans are police officers in Queensland.  if the Police Officer detects a ‘criminal offence’, fails to stop that offence from continuing, then is it a dereliction of duty?  I was once told by a Police officer that speeding was like running down the street with a loaded gun.  I asked him if he would take a photo of someone doing this and fine him weeks later?  No response.

If speeding was so dangerous, isn’t it a responsibility of the enforcers to stop this action immediately?  How dangerous is it really when they just let you keep doing this ‘extremely dangerous’ action even after detection.  Under their information you are dangerous and potentially putting lives in danger at that exact moment.  Not a week or two later. 

So apparently they are NOT wanting to save lives at all. Just my 2 cents worth.
