Further proof of unjustified fines being issued – just in time for Xmas!
Unfortunately, we’re confident that regular readers of these update e-mails will not be at all surprised by the title to this week’s update. In fact, those who have been Members or Subscribers of Aussie Speeding Fines for over a year will know all too well that there are simply more and more unjust, unlawful and incorrect fines being issued every day and, the Christmas/New Year period is traditionally the time that more of these fines are issued than ever.
So, if you want a sad, confronting, but truthful glimpse into what is in store for you, your loved ones, friends, family and work colleagues over the coming months, have a read over the following few stories. The key point that we urge you all to take on board is that this article proves what we have been saying since our inception – over 3 and a half years ago – speed cameras are placed in areas that raise the most revenue and not, as they are supposed to be, in known blackspot areas, in order to reduce accidents. In fact, we have had information on our on-line petition page – https://aussiespeedingfines.com/about-asf/petition-to-remove-cameras/ – for years now that proves that these cameras actually increase accidents. Please, if you haven’t yet read these eye opening international studies and added your name to our petition, then please do so ASAP.
In fact, the 3rd last line of that Sunday Telegraph article clearly states that “there has been a rise in crashes since the installation of the camera in 2007, which reaps $1 million a year.” So, it’s not only overseas that cameras have been proven to cause crashes, it right here on our very own soil too.
And, we couldn’t leave this story without referring to the 2 closing lines. Firstly, of course Mr Borger is “confident in the value of cameras” they are making him/his government a killing! And secondly, research that has been conduct the world over as well as the facts and statistics on our Vision for the Future page

The sad fact is that there are more and more new cameras going up every day – for example, if you live in QLD, just do a quick Google search under “new fixed speed camera northbound M1” and see how many blogs and articles there are in relation to just those new cameras alone. Or, if you live in WA, go back to the front page of The Extra, Nov 26 – Dec 2, 2010 “A West Australian Newspaper publication, where this a big story on the new hand held speed detection devices that the WA Police have just been issued – right in time for Christmas.
So, please, how much longer are you going to allow these revenue raising cameras and speed detection devices to continue stealing money from completely innocent motorists, under the false misleading guise of “road safety”?
We are just about to embark on the busiest time of year for the Government’s revenue raising “flash for cash” program, in fact, many states have started already and the introduction of double demerit points is also just around the corner.
And all for what? Speed cameras do not save lives – we currently have more speed cameras around the country then ever before yet the road toll continues to climb. Speed cameras do not cause people to slow down – the fact that more and more fines are being handed out every year proves that, surely people would be speeding less and fewer tickets would be issued if speed cameras really were the deterrent the police try and make us believe they are.
No, have no doubt, speed cameras are there for one reason and one reason only – to raise as much revenue for the various governments as possible. And, when are there more drivers on the road and therefore, the highest possible chance of making the most amount of money possible – the Christmas/New Year period.
Please, we urge you, don’t become another victim of the Governments revenue raising this holiday period and don’t let your friends, family or work colleagues become one either. PROOF, from actual court cases, that fines are wrong and CAN be beaten!
We have been inundated with media articles this week from Members who are not only fed up with being subjected to unjust and unlawful fines but are sick to death of the media reports that constantly show that these ridiculous revenue raising devices are clearly faulty yet the government agencies concerned will not remove them because they are raking in so much money.
Now, as the opening line to this update says, the only reason these devices still exist and the only reason that people are still receiving unjust and unlawful fines is because people are still letting them get away with it. As we saw in the recent Victorian elections, if enough people stand up and speak their mind, changes can and will happen!
We will let you digest the following stories and make up your mind for yourselves and if, at the end of these media articles, you too decide that you have had enough then we will urge you to please stand up and actually do something about it because if you keep paying your fines, giving in and allowing these agencies to keep getting away with it, then they will continue fleecing motorists until there is nothing left to take.
Our first and most powerful story comes from Melbourne and details an ex-police officer – yes, one of the very people who used to book motorists himself – who has now turned the tables and successfully defeated an unjust and unlawful speed camera fine. You will note, in the following story, that this senior Police Member warns that “others may have been caught because vehicles traveling faster nearby had triggered a camera.” Now, this clearly flies in the face of the closing statement in that article from an un-named spokeswoman – as opposed to a senior Police Officer – that suggests that “Victoria’s camera system is ‘lane smart’ and that cameras operate autonomously in each lane.” Clearly they don’t and the Prosecution couldn’t prove that they do otherwise the fine would have been upheld. You will also note the large graphics at the top of the article – “Cashing in on Cameras” and the related stories. Victoria is the most fined state in Australia but other states, such as NSW and QLD are quickly catching up and, unless we all take a stand and fight every fine we get it is only going to get worse! As Mr Rumbold states, many people are a bit over-awed by going to court but, as you will read on our Testimonials page – https://aussiespeedingfines.com/testimonials/ – when you are armed with the information in our e-book, you will find that it is often far less daunting than you thought.

And here’s another testimonial that we received from a Member this week who simply “threatened” to take an unjust fine to court and had the fine dropped:
Hi,
In December 2009 we went to Queensland were we were photographed at Warwick by a speed camera. At first we tried to transfer the ownership of the fine to the person who drove the car but the correspondence was returned because of our illegible writing.
Before the allowed 28 days to respond expired, a letter from SPER (debt collection agency) arrived. At this point of time we stopped the whole process and requested that the SPER process be cancelled. It took them another 3 months before it happened.
After we transferred the responsibilities, a leniency letter was drafted but was rejected. It was followed by a statement that there was a number of people in the car and we didn’t know who exactly drove the car. They didn’t care, all they wanted were money.
We threatened to go to the court, but before we go there, we asked for all the camera credentials, as suggested in the ASF book. The reply was the fine was withdrawn, because of the system error.
Thank you ASF it was worth the initial outlay.

So, as these stories show, a number of police have successfully challenged their fines and defeated them. Our next story comes from South Australia – yet another state that is issuing more and more fines to its motorists each year – but worse still, it is not only the number of fines they are issuing but the cost of those fines. As we have asked since our inception, who is the “victim” if you exceed an arbitrary posted speed limit? There simply isn’t one! And, if there’s no victim then there is, quite obviously, no crime. So, where on earth do they get off charging a “victims of crime” levy when there is no victim and no crime? They get away with it because people keep paying their fines rather than fighting them and, therefore, letting them get away with it. Please understand, as the old saying goes, “if you’re not part of the solution then you’re part of the problem.” It’s just that simple. If you pay a fine that you know you shouldn’t then you a contributing to the problem and making things worse for yourself and everyone else – period.
Now, please don’t get us wrong, if you speed and have an accident and cause someone pain, harm or deprive them in any way then you should definitely be fined and indeed, pay a victim of crime levy. But, as we detail in our e-book, if you have an accident – whether because you were speeding or not – you will face a multitude of other charges – vehicular manslaughter, intentionally cause injury, losing control of your vehicle etc. These are real charges and they are “just” punishment for causing someone harm or depriving them of something – exceeding an arbitrary speed limit doesn’t hurt anyone, it doesn’t deprive anyone of anything and, as is detailed on our Vision for the Future page – https://aussiespeedingfines.com/about-asf/vision-for-the-future/ – “speed” is actually only a factor – not even “the” factor, just “a” factor – in just 5% of accidents. Speeding is not a crime and therefore no punishment – read “fine/penalty” – is justified.
And, as usual, this article, like many others, refers to “Government Budget Forecasts” in the millions of dollars from speeding fines, yet they crap on about how fines were “geared towards deterring drivers from speeding as well as saving lives” and it would be “delighted if it failed to raise a cent”. Again, we ask, if these cameras really are the “deterrent” that the Government claims them to be then how can they possibly forecast an increase, in the millions of dollars, of speeding fines revenue? It just doesn’t make sense and it’s time to do something about it!
Now, as you know, our information doesn’t just relate to speeding fines, it relates to all unjust and unlawful fines, including parking fines and, as the next story shows, when they start actually “fabricating” fines out of thin air then you are definitely going to have to be armed with our step-by-step information so that you can quickly and effectively defeat these outrageous fines. Obviously, of even greater concern, is the coalition’s admission that, even though they know that most people no longer have confidence in speed cameras – in fact, almost 94%, as per the figures in the left hand column show – they will still retain them. Why? Because they make the Government – no matter which one is in power – a hell of a lot of money!
Please understand that these governments are there to serve us, not themselves. The general motoring public has lost all faith in the speed camera program and it would be an un-educated and/or ill informed person that believed that they existed for anything other than raising revenue – as the figures on the side of that article shows. We have had international reports, studies and articles on our Petition to remove Cameras page – https://aussiespeedingfines.com/about-asf/petition-to-remove-cameras/ – for over 3 years now that categorically prove that these cameras actually increase accidents. So, why do people keep paying fines that they know are unjust – especially when our licence saving information is so accessible?
The only possible answer is that there are still people out there that don’t know about our website and our information and that’s where we really need your help to spread the word. You sent me some bumper stickers and business cards to me here in Townsville and honestly 50 b. cards were never going to be enough so I jumped on the printer and did another 6000. Went through a few ink cartridges but when you have been screwed by the system and want to get back at the system you don’t mind a bit of time and expense to go the extra mile to inform as many people as possible.
Rather than hand them to the general public and take the unnecessary risk of informing a policeman or lawyer what I was doing, I decided to go into as many shops in the CBD as possible and hand them to staff or the owner to put on the lunch room staff table and to also hand to family and friends. (Gave out 1000). The response I got was 100% positive. Everyone at some stage had been done for parking in the CBD. I was given free drinks at cafe establishments, I got to meet beautiful women in hairdressers, florists, lingerie and clothes shops and felt so good about myself doing something that got a positive response from the public it was euphoric.
I don’t know how many requests you will get for the booklet but with a few large shopping centres around, coming up to Xmas I feel the other 5000 will go pretty quickly.

Again, we certainly don’t expect people to go to these extreme lengths, although we certainly appreciate Phil’s commitment and would encourage others to do everything they can. We are finally starting to win the war against unjust and unlawful fines!
Wow! What a fantastic response we had to our last e-mail update and, in particular, the huge increase in the number of Members of our Facebook group – we now have almost five times as many Members as we previously had, and all in just 2 weeks! As always, we have received a number of e-mails and articles this week from Members that are worth passing on. Before we do that though, we have received a heap of e-mails regarding the new speed cameras in QLD that look like tradies utes. Now, we actually wrote to everyone about those in our last e-mail update and, whilst we would always prefer to receive an article or information twice rather than miss out on it altogether, it does seem to suggest that not all Members are reading these regular e-mail updates. Okay, so onto some of the new articles that we received this past week. In essence, the WA Police allegedly detected a mechanic speeding in a customer’s Lamborghini, at 160 km/h in a 90 km/h zone. Please note that this story came out at the same time that the Assistant Commissioner of Victoria Police admitted that the anti-hoon laws were not working.
In any event, the matter finally went to court and, as you can read for yourself in the following article – not only did the mechanic beat the charges against him but he was also awarded $18,000 in cost. Please understand, this was not the Lamborghini owner with endless amounts of money to throw at a lawyer, it was simply a mechanic who successfully proved that he was not speeding. If this mechanic can victoriously fight such a large fine and not only win but get $18,000 in compensation then surely, as an ASF Member, armed with all the information that we provide in our e-book, you can defeat any unjust and unlawful fine that you are likely to receive in your lifetime!
Now, our second story follows on from our first extremely well because it is confirms what we have been saying all along that, although the suggestion is quite controversial, experts agree that driving up to 40% faster will actually reduce accidents so, even if the mechanic referred to in our previous story was, in fact, doing those speeds, he likely would have been doing them very safely. Our final story this week comes from NSW where a council has now decided to take the very drastic – and very welcome – step of issuing parking tickets to speed cameras that park on their nature strip. We can’t wait to get our first speed camera operator join up as a Member to try and defeat a parking fine – that will certainly be an interesting dilemma for us! Hopefully though, this is the beginning of the end for mobile speed cameras and, with everyone’s support and help in spreading the word and fighting back against their fines, we will soon be hearing stories of speed cameras being removed and turned off around Australia as they have been now in many parts of the US and the UK. The second is from a Member who stuck to his guns and took a speeding fine to court. After using our guidelines for making a Freedom of Information (FOI) request he then baffled them with some of the legal arguments that are raised in our e-book – which they simply couldn’t answer – and had the charges against him dismissed:
Hi Guys,
I challenged a fine and asked for lots of info and even a right to info form I sent was not complied with and my money sent back. The fine was sent to me, I was not the regestered owner of the car the fine was sent to me. Our partnership is the owner. I sent the fine back told them the story with no luck. I ended up in court and beat the cops.
The judge said he could not make heads or tails of the act 124 ,120 and so on transport operations and threw it out as the acting officer didnt know any thing about the case as the paper work came from brisbane she said.

The simple fact is that, when you are armed with our information, it doesn’t matter who you are, where you are from or what your particular fine is. As long as you take a stand and fight back against unjust fines then you can and will win and, when enough people start defeating their fines and the billion dollars a year that is currently being raised stops flowing into the government coffers, then we will be able to put an end to this current ridiculous and ineffective system.

We would like to begin this week by thanking you all for the many ideas and suggestions that so many of you came back with as a result of last weeks e-mail update, in regards to what else we can do to help spread the word and get our valuable, licence saving information into the hands of as many Australian motorists as possible.
By far the most overwhelming response we received was in relation to a Facebook page. Now, we have actually had a Facebook page for 6 months or so now but, given that we are experts in the area of informing and educating motorists on how to defeat their unjust and unlawful fines and not in the area of IT and/or marketing, we haven’t done a lot in the way of promoting that Facebook page. But, thanks to all the ideas and suggestions we have from all of you, that is something that we have been working on and will continue working on over the coming weeks.

Another very good suggestion that was made by a couple of existing Members was in respect to video nights. As many of you would no doubt be aware, we have a copy of a seminar we ran a few years back available on a DVD. Unlike the information in the e-book, which is subject to copyright laws, the DVD itself is not and we would welcome you all to get a copy and to have screening nights with your friends, family, co-workers or any groups that you may be a part of – local footy club, bowling group, poker night etc. – and share the information on that DVD with as many people as possible.
At the end of the day, it doesn’t really matter what you do specifically, all we ask is that you do something to help spread the word and make some changes because, as you will see from the following articles, the system really is out of control and if we don’t all get together now and do something about it, it may very well be too late.

Please note that the person being interviewed – John Lambert, the ex-manager of Road Safety at Vicroads – has supplied us with a lot of information that we have incorporated into our e-book as well as many of the statistics that are provided on our website. If anyone was to know the truth about these devices, it is John. Besides, check out the cop who is interviewed later on, his body language and his very poor attempt at avoiding the questions being put to him show that he too knows the truth but, quite obviously, cannot speak about it as freely as John.
The sad fact is that the details of this interview are really nothing new, they have been on our website for over 3 and a half years now – it’s just that John was finally fed up with all the garbage in the media and he felt like he had to step up and say something to set the record straight – and we are very grateful that he did.
Having said that, there are a number of other, lesser known,“sneaky” tactics the police are now using to extract money from motorists, one of which is detailed in our second article this week. Our biggest issue with this entire article is not, as many would think, that the officer concerned got off the fine – because we show our Members how easy that is to do in our e-book. No, our biggest issue is the actual title – “No-one is safe from the tricky speed squad.” The whole purpose of the entire “speed detection system” is supposed to be as a clear and obvious deterrent to drivers and only a strong marked police presence will achieve that. All that these covert operations achieve is additional revenue for the government and thankfully, every so often, it is their own Members that are the subject of these mischievous and deceptive practices.
This article comes to us on the back of an e-mail that we have received many times over the past week or so from motorists in QLD regarding the use of new utes as speed camera vehicles, that are specifically designed to look like “tradies” utes – yet another underhanded and deliberately “sneaky” tactic. Unfortunately, we can confirm that these new ute based speed cameras are real, and one of our unsuspecting QLD Members has already e-mailed us to say that he has been photographed by one. Obviously, this is of no real concern because, these cameras, like all speed cameras, are fundamentally flawed and, by using the information in our e-book to fight back against these fines, you can successfully defeat them. We only mention it so that, if you are driving around in QLD, you can keep an eye out for them.
Now, if these subversive tactics are not enough, let’s have a look at another revelation from NSW, which shows that speed camera operators are now receiving a cash incentive if they successfully prosecute more drivers – https://www.dailytelegraph.com.au/news/speed-camera-private-cash-bonus/story-e6freuy9-1225945819267
The concerns raised in this story are obvious and valid, what is not as obvious, is the other important information that can be gleaned from this story – specifically, that there are many factors that relate to the successful prosecution – or otherwise – of a motorist and that not all speed camera fines are the same, as many people incorrectly believe. As this article details, there are many factors that affect how easily a motorist can fight a speed camera fine, such as, image quality, verified incident files, as opposed to un-verified incident files etc. All this simply means that speed camera fines can and should be fought.
So, if the fact that speed camera operators are now being rewarded for prosecuting more drivers offends you – as well as the information detailed in the previous articles, especially the Current Affair story – then please, do something about it! Now, it’s not all bad news this week, in fact, quite the opposite. A number of Members sent us an article from a QLD publication that detailed how a lady that took on the entire State of Queensland and set a precedent in the High Court of Australia regarding photos from speed cameras being inadmissible. Of course, the QLD Police have now managed to wrangle a way around this being used as a precedent but the story does go to show that, even without legal representation, you can take on the system and win. Unfortunately, we don’t have a digital link to the story but we can certainly e-mail a PDF copy to anyone who would like to read it for themselves, if they haven’t come across it already.
There is also good news out of the US where two cities have now banned the use of red light cameras because the authorities there have seen them for exactly what they are – revenue raising devices that have absolutely nothing to do with road safety. If you read these e-mails and do nothing then you can only blame yourself when you, your friends, your family and work colleagues continue to be ripped off by flawed, faulty and ineffective speed and red light cameras and then watch as we rapidly become completely police run states. However, if that is not what you want for yourself and those you care about then you need to step up and do something about it. You need to pass these e-mails onto as many people as you can, you need to sign our on-line petition page and encourage others to do that same, you need to get a copy of our e-book and ensure that everyone you know gets a copy for themselves and then, if you really want to help make a difference, you need to help us spread the word to all other Australian motorists by handing out our business cards and/or bumper stickers – which we send out completely free of charge.
The choice is yours, either end up with cameras like those new ones being introduced in Britain dotted all over our streets or, do as the following people have done and use our information to fight back against unjust and unlawful fines and send a clear and united message that this corrupt system will no longer be tolerated by the motorists of this great country.

We may have revealed yet another flaw in the camera system.
I was travelling from Mortlake to Warrnambool when I was apprehended for speeding. The police car was in a side lane at the end of a bend. I was waved down by the officer as I passed her car that was still in the lane.
I asked the officer how she managed to get an accurate reading from that position. She said that she got a reading head on to me. I immediately said that is impossible as I went past you while you were still in the lane. She blushed and said that is your right to challenge if you wish. I said that I would definitely take the matter to court.
The officer rang me one week later and said that the infringement notice had been withdrawn and the reason that she gave was that she had not REGISTERED HER SPEED AT THE TIME OF TAKING A READING ON ME. This must mean that if the police car is moving or stationary they must record their speed at the time in order to accurately calculate the speed of the alleged infringing car.
Are we on a winner!!!.

Hi Guys,
I received a red light camera fine but was not the driver at the time of the offence. I used your information to draft a number of letters explaining to the Traffic Camera Office that I did not know and could not, with reasonable due diligence, ascertain the name and address of the person who was driving the vehicle at the time.
The fine was subsequently withdrawn.

If the ASF system is so good then why isn’t EVERYONE using it?
The title to this week’s e-mail is a question that we get asked almost every week, in one form or another, and there is a very simple answer – because not “everyone” knows about us yet.
You see, even more often than we receive this question, we receive e-mails saying things like “If only I knew about you guys 6 months ago …..” or similar. For whatever reason, despite our existence for over 3 and a half years now, it seems as though there are still far too many people that don’t know about our website and our information.
Now, we spend hundreds, if not thousands of dollars, every month on advertising on Google and the like, we send out business cards and bumpers tickers to anyone who is interested, completely free of charge, and we even have an affiliate program where Members can earn a 33% commission for every person they send us who joins up. But, apparently, this is still not enough.
So, this week, we are asking you all for ideas, contributions, suggestions, assistance – anything you can offer or provide us with to help spread the word and get our message out there. Now, obviously, we would never ask you to endorse a product that you didn’t believe in, you didn’t know worked or you didn’t think was necessary, so please take the time to read through the remainder of this e-mail and go through the media articles that have come across our desk in the last week that should well and truly cover these points.
Our first few articles relate to known speeding fines “loopholes”. The first of which is a report by Today Tonight that admits these loopholes do actually exist, you just need to know what they are – https://au.todaytonight.yahoo.com/article/8128593/general/speeding-fine-loophole – which, of course, is one of the first things we cover in our e-book.
This particular article points out that 50% of people who asked for a review had their fines dropped, the problem is that only 5.5% of people who received a fine actually asked for a review. So, the first key is to know when you can ask for a review and the second is to know how to ask for it in the most effective way – which is precisely what we cover in our e-book.

How do you become one of these drivers when these agencies try and bury all this information as much as they can? Again, the figures are the same and the only difference between those that end up paying an unjust and unlawful fine and those who avoid doing so is in information and education, that those who are supposed to be “protecting and serving us” keep hidden – our e-book exposes all these loopholes in great detail.

Just an update, for your information. Not sure if you remember, as l am sure you address thousands of emails but a brief recap.
Booked on Eastlink at the Wellington Rd bridge camera point on 12/12/2008 at 4:05pm.Alleged speed: 109Km/h
Since then, l have used your Ebook and followed it to the letter, as well as sending questions to you on different occasions.
Final court date was 06/10/2010 as you can see managed to prolong this for 2 1/2 years, and in that time much has been learnt about this faulty money revenue system (speed cameras).
The police have tried to bully and intimidate me throughout this period but l have stood firm.
Admittedly l have had many feelings of ups and downs during this time, as some days it seemed l had a strong case but on others it seemed l had no chance, but l persisted with the notion that nothing ventured nothing gained.
My first actual hearing date after l had adjourned the original dates was the 21/07/2010 were the state tried to bully and bullshit me into pleading guilty, by taking me into a private room outside of the court room. May l add that at this point the state also made me aware of the provision in the act that allows that in the state of Vic if you have had a clean driving record for 2 x years and the speeding charge is for less than 10Km/h you can apply for a waver, but then proceeded to inform me that now that l am in court l can no longer take advantage of the provision.
(Now this is a provision that you should make all members aware of.)
Obviously l stood my ground and when we went back into the courtroom l advised the judge that l would not change my plea and would still plead NOT GUILTY.
l also advised the judge (She seemed reasonable) that l would be issuing a summons for Breeze (the EastLink toll people) as l had the gantries times as well as 2 x independent witnesses (one was in the car with me and the other was in a separate car behind me).
The state said that they would bring in a speed camera expert as a wittiness.
When l reappeared in court on the 06/10/2010, the state was wise to my plan so they did not bring in the camera expert, so l had no one to question, the only person from the state was the prosecutor.
The court had also made me aware of a case that had just passed, that was now precedence, l think it was called the “Galliger case” were l had to prove any of my claims and that it was not good enough to just swear the evidence.
So to cut a long story short (about 1.5hr on the stand);
1. My 2 x witnesses were of no use.
2. My statement of not speeding and having my cruise control on, was of no use.
3. The Eastlink gantries times and Eastlink staff, was inconclusive and not substantial.
4. The fact that l had not had a traffic infringement in over 15 Years was of no use.
5. All the information of the Wellington Rd speed camera problems , was inadmissible.
6. The proving the photo was not tampered, was thrown out.
7. 2 x cars in the photo grounds for interference, thrown out.
You can see were this is going……..
So it became quite clear to me that the only chance l had was to fight them on law.
Argued:
1. That the Certificate they produced (the photo of my car with the digital speed reading) requires the serial number of the camera that took the photo as per the regulation.
2. The person signing the Certificate who claims to be authorised by the Chief Commissioner of police, what is his Authority?
3. The signature on the certificate that should be of Kevin Boulton is in fact not his signature. Compared his signature with other certificates and they were all different.
The judge thought all 3 x point had merit, even though the state strongly tried to argue against all 3 x points.
The judge stated that she would need sometime to make a decision, and set another court day for the 10/11/2010.
Today l received a letter from Victoria Police stating;
“The prosecution office has review your file and a decision made to withdraw this matter. I have notified the court that this matter is to be withdrawn. The matter is now finalized and you are not required to attend court on the 10/11/2010.”
A win for the common man, thanks for you assistants.

We were recently bringing a car from Queensland to Melbourne and stopped in at Canberra for a couple of days. During that time it is alleged that we exceeded the speed limit. The notice arrived approx. 30 days after.
I rang and explained that there were three of us driving and it was impossible to nominate. The attendee said to nominate any of the three as there are no demerit points allocated if the infringement is interstate. I received the relevant documents and there on them it states that if you knowingly forward false information there is a four year jail term.

Now, on the face of it, it would seem almost justifiable to put a fixed camera in the area that they cover in this article. However, when one refers to the mobile camera policy manual – which must surely be similar to any fixed camera policies – it states that cameras are only to be used in construction areas when there is actually construction going on – not 24 hours, 7 days a week, like this camera would be used! Once more, motorists being conned out of money because they don’t know that these agencies are using these devices contrary to their own rules and guidelines.
We have said it a million times and we will continue saying it – speed cameras do not save lives, all they do is raise revenue! Look how many unjust fines are now being beaten!
Well, it’s been another busy couple of weeks since our last update hence, why we are still working and sending out updates on a Sunday, instead of watching Bathurst. And, once again, we have received a number of media articles relating to yet more faulty fines that have been comprehensively beaten because people made the effort to fight back.
The first is actually an interesting “double team” story from a father and son who both received unjust fines, they both fought back and they both won! Now, these guys are obviously not ASF Members and chose to use a lawyer to beat their fines and that’s okay, we don’t care who you use or what information you use, as long as you fight back against every unjust fine you receive. Once again, this guy beat his fine by using the one of the fundamental principles that we tell our Members – the agency must have two photos to make a red light camera fine stick, one showing you behind the white line after the lights is red and then another (at a further point in time) showing you continuing through the intersection when the light is still red. If they don’t have both photos then they have no case against you – or certainly not one that will stick.
Whilst it is heartwarming to read a story from an “average Joe” who has successfully fought back against a fine, on his own, with no lawyers, and won, what concerns us greatly about this story is the statement from the Victoria Police spokeswoman that, even though the cameras was clearly shown to be faulty – otherwise, why would it produce an incorrect time stamp on the photo (a fault is a fault, period) – the camera is still operating and very likely snapping other, completely innocent motorists who don’t have our information and don’t know how simple it is to fight back against an unjust fine and beat it.
This is why we would firstly urge you all to go to our on-line petition page – https://aussiespeedingfines.com/about-asf/petition-to-remove-cameras/ – to have all speed and red light cameras removed and add your signature. Then, we would ask you to get all your friends, family, work colleagues etc. to do the same.
Remember, the only way we are going to put an end to this ridiculous and ineffective system is if we can get every motorist to fight back against every unjust and unlawful fine they get.
And, on that note, we know we usually leave this to the end of each e-mail, but it is just so important that every motorist in this country have access to our information that we would invite every one of you reading this to grab some of our business cards and/or bumper stickers to help spread the word. And that really is the principle that we are trying to get across to people. In fact, after that story broke, a journalist actually admitted that, despite being scared, despite having no lawyer acting for her and despite not one, but two officers giving evidence against her, she too managed to fight back against her unjust red light fine and win. Media confirmation of faulty speed cameras and what you can do about it!
Our leading story this week comes from a 3 page spread in Melbourne’s Herald Sun newspaper which details the full extent of faults with the cameras on the Eastlink Freeway that have been notorious for the issuing of a huge number of unjust and unlawful fines. In fact, some 450 motorists are being wrongly fined each and every day on Eastlink and, when you read about the various faults that have been uncovered in the Herald Sun report you will shocked and outraged that these cameras are allowed to continue operating.
There were actually so many faults and concerns uncovered by the Herald Sun that they actually wrote up, not one, but two separate and detailed articles. Please understand that, whether you live in Melbourne or not, these two articles are extremely important because only a fool would think that these are the only cameras in Australia that are faulty.
The first story categorically states that one camera was taking photos when it wasn’t meant to. Now, this is fairly easy to determine if there are photos with no vehicles in them but how many other photos were taken, that did show vehicles in them but these vehicles did not trigger the camera? The Government insists that no incorrect speeding fines were issued despite the investigation showing the camera, which was known to be faulty – which doesn’t cover all the others which haven’t yet been shown to be faulty – wasn’t changed until a month after it the fault was detected. So, how can the Government be so sure that “No incorrect speeding fines were issued”? Quite clearly, they can’t!
The second story is even more damning than the first and openly states that “speed cameras took images they weren’t supposed to, contained corrupt data and had communication blackouts.” Once again, if you’re reading this and you believe that the Eastlink cameras are the only cameras in this country that are subject to these faults then we have a really great bridge we’d like to sell you!
The fact is, as this story reveals, there has plain and simply been a cover up in respect to the flaws and faults with these cameras and completely innocent motorists – such as the ones specifically named in that story – are being fined each and every day. The story goes onto detail a long list of faults that have now been discovered with these cameras and one can reasonably assume that many other cameras around the country are also affected by similar problems – they just haven’t been exposed yet.
And, that is precisely the purpose of our e-book – to show motorists who have been unfairly and unjustly fined, how to fight back against these ridiculous and ineffective fines. If we can get all our Members to sign every such petition, and/or to promote and endorse every such campaign, then we have a real chance at putting an end to these corrupt revenue raising devices in the very near future.
You will also see, on that page, that we have links to numerous articles that show that speed and red light cameras actually cause more accidents than they save. We were sent the follow article from the US which shows that, despite speed cameras being removed in many states across the US, the road toll has actually decreased. What you will read about though is many of the factors that we have noted on our Vision for the Future page – https://aussiespeedingfines.com/about-asf/vision-for-the-future/ – for over 3 years now, that we need to get rid of drunk drivers, train people to pay more attention, be more safety conscious and embrace the new safety technology that is now built into our cars – absolutely nothing to do with reducing speed limits, greater speed enforcement or, in fact, anything to do with “speed” at all.
However, as we state on our on-line petition page, it’s not just the speed cameras, it’s also the red light cameras too. Once again, this article clearly states that cameras have supposedly “detected” instances of red light running and speeding “which didn’t actually happen” but the police insist that “the false fines are all stopped before they are issued”. Really? And where exactly is any evidence to back up that blatant and deliberately misleading lie? The list of faults with these cameras is just as high as the faults with the speed cameras mentioned earlier, which all adds up to completely innocent motorists being unjustly and unfairly fined.
And, last but not least, we have our other pet hate, parking fines and, con-incidentally, another shocking and outrageous story that we came across this week was one that detailed the huge increase in parking fines in Queensland, including a particular street that has netted the Brisbane Council $3 million in just one year – all from completely unjust and unlawful parking fines! Whilst the article very kindly tells you which streets to be aware of, it fails to note that most important factor in respect to these fines, which is that they are all completely unlawful. As we explain in our e-book and, as was confirmed more recently in the letter from the Attorney General’s Office, which you can download from either our News/Updates page or our About Parking Fines page – no “council” in Australia has any lawful authority to issue these fines and therefore, anyone who receives such a fine should use the information in our e-book to fight it.

Landmark Supreme Court victory for the ASF system!
Well, it has been another busy time since our last e-mail update and we have again been sent a number of very important media articles which we will refer to shortly.
However, our lead story this week is the landmark case that was decided in the Supreme Court of Queensland Court of Appeal last week that again backs up what we tell our Members in our e-book – that no photo from a speed camera can be used against you in court (and therefore they have no case) if you know how to correctly question its authenticity. The only way this major case precedent can be overturned now is by application to the High Court of Australia, which they, almost certainly, will not do. So, for all those who still doubt the information in our e-book or require further proof that our information works, is relevant and will stand up in court, there it is.

Look at the hell this poor lady have been put through all because these agencies refuse to listen to reason, because they know that most people will simply give in and “pay up”. The opening part of this article backs up what we have been saying all along, that the money that is stolen from motorists by these ridiculous revenue raising devices is not put back into any form of “road safety” program, as these lying government agencies would have us believe.
You will note that towards the middle of the story the presenter refers to the speed cameras that were turned off in Swindon, in the UK, over a year ago and there was not a huge increase in accidents or fatalities as some so-called “experts” predicted.

Also, of interest – from the Today Tonight video – was the so-called “lawyer” from the Local Government Association of Australia who referred to three tiers of government, yet, as any of you who have read the letter from the Attorney General’s Office that is on our News/Updates page – https://aussiespeedingfines.com/news-updates/ – will know, the Constitution only allows for two levels of government and not three. So, although we congratulate the deputy mayor of Gosford for his stand, he is, unfortunately, also operating from an unlawful position.
And finally, the less said about the Professor’s comments – at the end of the video regarding increasing the number of speed cameras – the better. No Professor is worth a pinch of salt if he makes comments that can’t possibly be backed up – there is absolutely no evidence to show that the 11 lives he refers to were in any way “saved” by any covert speed cameras. Clearly, he hasn’t been to our on-line petition page – https://aussiespeedingfines.com/about-asf/petition-to-remove-cameras/ – which shows that not only does the average motorist in this country no longer believe in the effectiveness of the current speed camera program but research has also shown that speed cameras actually increase accidents!

And finally, as if all of this wasn’t enough, here is another story out of the UK that shows that the police officers themselves know that the hand held devices that they use are inaccurate. Hopefully, after watching these videos and reading these articles, you will be as enraged as we are and committed to doing everything in your power to put an end to these ridiculous, ineffective, revenue raising devices. More Information on How to Beat All Council Fines!
First and foremost, this week, we would like to let everyone know that the ground-breaking letter from the Attorney General’s Office – which declares that local councils have no authority to act as a local government under the Constitution and hence, all parking fines are entirely unlawful – has now been uploaded to our website.

Now, please don’t get confused, local councils do have a lawful right to exist but they, like most of these other so-called “government departments” are just companies, they are not part of the Government and, as per the above information, they do not have authority to act as a Government department or enforce anything pursuant to any Local Government Acts – which they often rely on – because these Acts are in contravention of the Constitution.
In a nutshell, they have no lawful right to issue any fines at all. And this is why our Members have managed to successfully use out information to, not only defeat parking fines, but also other “council” related fines, including a lady who actually got off two “un-registered dog” fines last year with our information. I thought I would share my experience with you.
I am the owner of two small dogs and have had some trouble with my local City Council in relation to barking dogs and dogs not being registered.
Recently I received infringement notices for my two dogs not being registered with the council, they were micro chipped and do not leave the secure yard. I received a warning letter from my council (dated 29 Aug) stating that I had 21 days to register the non dangerous companion dogs or a on the spot fine of $165 would be issued for each dog. On 3 Sep I received two on the spot fines from the council stating that I had not registered my companion dogs. I paid both registrations within the 21 days so assumed the on the spot fines would not apply.
I called the council and was informed that the on the spot fines did not have anything to do with the warning letter I received a couple of days prior to the fines being issued. The lady on the other end of the phone said “how was the issuing office supposed to know about a computer generated mail out” and I was to pay the fine. How any issuing officer from the same department does not know about a general mail out is beyond me, do these councils have any internal communication? This did not seem fair to me so I sent a letter with the accompanying fine to the SDRO. The SDRO notified my that the fine still applied so I returned the court notice.
So with my court attendance date I thought I would arm myself. After some investigation I found out that the SDRO has no jurisdiction over any fines relating to pets.
As a last ditch attempt to have the fines waivered thus saving me from going to court and paying the fines I wrote a letter to the GM of my council, letting him know of the unfair and unjust treatment received from his council.
I received a letter back from the council stating no further action would be taken. So my membership with aussie speeding fines has now paid for itself. Had I not purchased your book I would not have even believed I could get out of council revenue raising tactics.

Yet again, this week, we have received more media articles on the subject of speed fines and, in particular, speed cameras, that we believe are worthy of sharing with you, our Members and Subscribers.
We were going to start off this week by directing you to an amazing media article from Today Tonight. Now, we say “amazing” because it is the first unbiased, logical and sensible story on the subject of speed cameras that we have seen in a long time. This article shows the harsh and shocking fact that everywhere else in the world they are taking speed cameras down and removing them from service – because they have been shown to have absolutely no positive effect on the road toll – yet, here in Australia, despite a generally rising road toll, they are installing more.
However, when we went to get a link to the story, it had already been taken down. Isn’t that incredible? The first real media story showing why speed cameras don’t work and why so many other countries around the world are removing them yet, we’re installing more every day here in Australia and, in less then a week, the story disappears. So, if anyone managed to get a copy of that story or has found a way to create a link to it, please let us know so we can pass it onto everyone because it really did show everything that we have been explaining over the last few months in relation to how speed cameras have been removed in Hawaii, Canada, a number of states in the US and now also across the UK. Please note the comments at the bottom of the article which correctly point out that neither of the accidents detailed in the article had anything to do with speed, nor would they have been stopped by the introduction of more speed cameras.
Now, we know we’ve said it before but we will keep saying until the message gets through – speed cameras create more accidents than they save. As a final note, whilst we’re on the point of speed cameras, we also came across the following article this week as well – https://www.couriermail.com.au/news/queensland/queensland-police-threaten-to-turn-off-speed-cameras-take-sick-leave-en-masse-in-pay-dispute/story-e6freoof-1225899227718 Of particular note was the line from the Senior Constable – “Last weekend I spent four hours in a speed camera van and issued 178 fines. Imagine if next time I turned the camera off. That’s a lot of lost revenue.” Firstly, 178 fines were issued but no accidents were mentioned and secondly, he mentions that there would be a lot of lost revenue if the camera was turned off but made no mention of the increase in accidents that would occur as a result of the camera being turned off.
And, that’s because the whole premise of speed cameras, and the way speed camera fines work, means that they can’t reduce accidents. In fact, it was one of our Members that put it brilliantly when he e-mailed us and said “The only thing speed cameras prove, is that speed does NOT kill. The evidence being the fines arriving in our letterboxes which they fully expect us to pay after our “miraculous” survival – many days after the event.. ;)”
This same Member extrapolated on this point and sent us the follow up e-mail below:
Having been a long time member and bought a few copies, I know it’s priceless info. More needs to be elucidated to your readers:
Imagine Joe Bloggs, travelling to and from work every weekday, into a ridiculously slow speed limit, working his way through a mass of traffic willing to travel at only half that speed and being pinged by an unknown camera to and from work every day.
Considering the first fine can take 14 days (or longer) to arrive in his mailbox, on its discovery, he doesn’t know there’s another 19 coming..!
Even though each offence occurs on a different day, it’s still the same offence. Something must be said for double-jeopardy at least.
Many times I’ve been tempted to write on these blatantly blank envelopes they send:
“Return to sender. Driver deceased due to infallible ‘speed kills’ propaganda”.
Notably, this would incite the local SWAT team to kick down my door to check if I’m really dead – disbelieving their own mantra. Secondly, it would make for an interesting conversation with the judge who asks:
Judge: “Why did you write this lie on the envelope?”
Me: “Because I knew they wouldn’t believe their own propaganda, that speed DOESN’T kill and you’re expected to survive to pay the fine once it arrives in the mail, your worship, which is blatant false advertising for a start.
Judge: “I see..”
Me: “It goes so far as to say, your honour, that even when trying to do the right thing, camera’s actually cause crashes. I can’t count the sheer number of times I’ve had to swerve for some camera-panicked motorist attempting an untrained emergency stop 5 feet from an amber light at 50km/h. I have been trained with advanced driving courses and maintain my practice, which is why I’m alive today to stand before you”.

Obviously, there are aspects of this that are quite humorous but there are other aspects that are tragically correct and serious and, something really needs to be done about it.

Now, in the past, we have sent out a link to their annual report which shows the huge profits they are making, as well as the huge projections they have for future profits.
We often ask how the agencies here in Australia can come up with “projections” for revenue from devices that are supposed to cause people to slow down. After all, if these devices really did cause people to slow down then these devices wouldn’t make any money, would they? So, how does a company like Redflex make huge projections based on cameras that haven’t even been installed yet? Huge New Breakthrough that Declares all Parking Fines Unlawful!

However, what blew us away even more this week was the confirmation that we received – on letterhead from the Attorney General’s Office – that confirms what we have been saying for the last three and a half years – local councils have no lawful authority under the Australian Constitution.

I refer to your letter received on 10 June 2010 regarding the 1988 Referendum.
In 1988, four proposals to amend the Constitution were put to voters in accordance with section 128 of the Constitution. One of those proposals sought to give constitutional recognition to local government but the proposal was not carried.
The Constitution does not currently recognize local government. Any change to the Constitution to recognize local government would need to be approved by voters at a referendum. The Government will continue to explore reform, including constitutional recognition, to facilitate cooperation with local government.

So, let’s have a closer look at some of this week’s media articles and see exactly what they are saying on the topic of speed cameras and see how closely that mirrors the very points we have been making.
Our first article this week is actually a segment from Today Tonight in Adelaide where an ex-cop fought back against an utterly ridiculous, unjust and unlawful fine and won. We’re sure you won’t be too shocked to note that, just as he was about to create a major precedent that others could rely on, his case was withdrawn – watch right to the end of the clip and listen to the insane excuse they gave for doing so.

Please note this ex-cop’s words when describing the so-called “Road Safety Camera” that he was caught by – “There is no such thing” – and he finds the reference to be “offensive”. And this is one of the major points we have been making in respect to cameras all along, they are Revenue Raising Cameras, they are not Safety Cameras at all.
Now, apart from all our own research into speed cameras and the fact they actually increase accidents, which we have uploaded to our on-line petition page – https://aussiespeedingfines.com/about-asf/petition-to-remove-cameras/ – there is also a lot of other, independent research out there.
For example, check out the following page which categorically shows that, despite the enormous increase in the number of speed cameras being used, the road toll is not going down – https://www.caradvice.com.au/2852/road-toll-statistics-australia-getting-worse/ So where do they get off making wild and baseless claims that these devices “save lives” or that they are “Road Safety Cameras” – when the evidence clearly dictates otherwise!
The figures mentioned in this article speak volumes and, as the author states, “there was a seven per cent fall in the developed nations median road death rate per 100,000 population, but Australian’s rate rose two per cent …. it all goes to show the current road safety policy is failing.”
The fact that the increase in the number of speed cameras has had nothing to do with lowering the road toll is also clearly stated in this article from the UK – https://www.pistonheads.com/news/default.asp?storyId=22254 – the opening line says it all “Speed cameras do not have a major impact on road safety”. The article goes on to state that “Since the installation of the camera on Burton Road, for example, you look at the accident statistics and the number of incidents have gone up.” How many times do we have to say the same thing – “speed cameras cause more accidents than they stop.
Thankfully, in the UK, at least, they are doing something about this fact and, as the following article states, the government there is at least being honest by referring to speed cameras as the “war on motorists” and they are actually axing thousands of cameras across the country – https://www.thesun.co.uk/sol/homepage/news/3067998/1000s-of-speed-cams-face-axe.html
Now, without getting too political, like most wars, the war that is raging against the motorist in this country is a complete waste of time that will achieve nothing except raising a hell of a lot of money for the corrupt people who started the war.
We have now shown all of you who have read through our website and receive our regular e-mail updates that speed cameras have been removed in Hawaii, in Canada, in a number of States across the US and now, they’re about to be removed in the UK as well. The simple fact is that if they can remove them there then they can remove them here – we just have to make them!
The difficulty is that, despite all the evidence to the contrary, there are still people out there who have been so badly lied to and deceived – in essence, brainwashed – that they actually still believe in the speed camera program.
As we have said all along, there are two major issues that need to be looked at in respect to speed cameras – firstly, do they actually cause people to slow down and secondly, is “speed” and slowing down a relevant factor in accidents anyway?
Now, we don’t know how many more articles, research papers or studies we need to show you that prove, categorically, that there are no statistics in existence that show that speed cameras actually make people slow down. So, let’s just accept that they don’t and move onto the next point.
If you have taken the time to read over our Vision for the Future page – https://aussiespeedingfines.com/about-asf/vision-for-the-future/ – you will note the research and studies that show that speed is just A factor – not the single factor – in just 5% of accidents. And, as we explained in last week’s e-mail, there are no statistics that can break this 5% down and show the number of accidents where “excessive speed” was the factor. Speed itself is never the problem it is speed linked to another factor or it is excessive speed for the conditions that is the problem
In fact, whilst trying to make a completely separate point, the following media article makes our point perfectly – https://www.adelaidenow.com.au/news/south-australia/secret-traffic-survey-reveals-90000-a-week-bust-110kmh-limit/story-e6frea83-1225895813686 – because despite their statement that – “almost 90,000 motorists in a period of one week were recorded speeding in 110km/h zones on country roads.” – you will note the distinct lack of reporting of a single accident!
Please note, we’re not going to make any comment on whether exceeding the speed limit is “wrong”, we are simply making that point that if 90,000 motorists were detected exceeding the speed limit and, as they claim – “For every 5km/h over the speed limit, you double your chances of being in a casualty crash.” – why wasn’t there a single accident? No fatalities, no “casualties” not even a minor fender bender was recorded. The fact is that “speed” has little or nothing to do with accidents and there are no statistics on the planet that can prove otherwise.
So, if you have had enough of being taken for a ride by these agencies and their media rubbish, if you are ready to fight back and have these ridiculous revenue raising cameras removed from our roads then please help us spread the word and get a copy of our valuable, licence saving information into the hands of every motorist in Australia.

An update!
I elected to go to court and entered a plea of ‘Not guilty” on the basis that while I had been pulled over for ‘an improper U-turn’ the infringement notice read “an improper right turn” – something I definitely did not do…and I had witnesses.
Yesterday I got a letter telling me that (I quote):
“I have considered the circumstances surrounding the issue of this infringement and taking into account all information available to me I have decided to use my discretion in this instance and waive this infringement notice.”
So…thanks very much for giving me the encouragement to challenge this blatant revenue gathering ploy. I appreciate all your help.

well it has taken all day, and I only got a result, on one of them. I think the prosecutor thought he was having a easy run TODAY, I caught him having a laugh with the court reporter as I walked in to register. He didnt know I was the one he was laughing at, he was pretty down in the mouth by the end of the day when the judge said CASE DISMISSED.
It took all day just to run a statute of Limitations argument, he wasnt real well prepared for me to be a bit organised and Im exhausted. So it ran overtime and now I have to go back tomorrow for the second. Im, going to run the same argument, I expect the prosecutor wont be so ill prepared this time, but it is the same judge and he has the same issues in his head, hopefully I can be better prepared and he will not take so long.
You are right, they dont work a lot on the stand do they. Wish I could get a job like that, 18 hour days suck.

New Speed Cameras Coming to an Area Near You – Watch Out!
We have been absolutely inundated with e-mails from Members this past week or so, forwarding us articles about new speed cameras that have either been installed or are earmarked for installation. Then, on top of that, there are all the new mobile revenue raising cameras that are coming on-line.
Now, we appreciate that we keep saying it again and again but we will continue to say it until the message gets through to everyone – these cameras have nothing to do with road safety and everything to do with raising revenue. And, if we don’t all band together and fight back against these ridiculous and unjust fines then, very soon, it will all be too late, as the country will simply be saturated with them.
We don’t mean to be rude but, if this happens then we will have no-one to blame but ourselves. We need every motorist in Australia to fight back against every unjust and unlawful fine they receive. Hopefully some of the following articles will shock you, and those you know, into action.
Our first story this week is the one we have had forwarded to us the most, the new mobile speed cameras that are being deployed across NSW that can steal money from 6 innocent motorists a second!

The telling fact that should be of most concern to everyone reading this is that Macquarie Bank is involved in these cameras and, as we all know, banks are plain and simply in the business of making money – and a lot of it – so is there anyone reading this who is in any doubt as to the true purpose of these new cameras?
Once again, we know we’ve said it a thousand times before but people still don’t get it so we’ll say it one more time – if speed cameras really do work as a deterrent and cause people to slow down, as these agencies continue to falsely claim, then how on earth can they predict or forecast any amount of revenue from speed cameras, let alone such a ridiculously high one? The only way they can do that is if they know the cameras are inaccurate and/or deliberately set to give false readings and the speed limits are set artificially low.
About the only sensible line in the whole article is the last one – let’s see if the NRMA actually manage to get any such review!

Remember how we mentioned that Macquarie Bank was involved in these cameras? Who honestly thinks for a second that once these devices start raking in tens of millions of dollars each that they are not going to push for tens, if not hundreds, to be rolled out across the country?
Of greatest concern to us though, is the absolutely false line that suggests “Mobile speed cameras had reduced the road toll by 25 per cent in Queensland and 34 per cent in Victoria”. This is an out and out blatant lie and we challenge anyone out there to prove otherwise. Now, the issue is that every one of you reading this understands this fact but how many others out there will read that garbage and actually believe it? The media should be held to account and, if they can’t produce verifiable facts to back up this outlandish statement then they should be forced to retract it and apologise to all the gullable people who read it and believed it.

Unfortunately, it’s not just NSW that is about to get an influx of unjust and unlawful fines, Victoria has again been earmarked for new cameras, as if they don’t; already have enough. We read a saying once that said something along the lines of “Victoria – if you come here with a licence, we’ll make sure you leave without one” and the following page shows precisely how they are going about that. The fact is that speed cameras, whether fixed or mobile, do not save lives, they do not reduce the road toll and, in fact, research and studies have shown that they actually increase the number of accidents. Unfortunately though, it doesn’t stop there, we also received the following article which is now proposing a tolerance as low as just 4 km/h over the posted speed limit which, apart from being absolutely ludicrous is also totally unlawful, given the specifications of the Australian Design Rules.
Remember, the ADR’s are Commonwealth legislation and, at best, these new so-called “laws” are only State and, as per Section 109 of the Australian Constitution – “When a law of a State is inconsistent with a law of the Commonwealth, the latter shall prevail, and the former shall, to the extent of the inconsistency, be invalid.”

Now, just go back for a minute and combine this article with the other points we have raised in this week’s e-mail update: You have Maquarie Bank, as part owner of 6 new cameras – wholly and solely so they can earn more money – there has already been discussion of more cameras being released – that can fine 6 drivers per second – and now they’re talking about reducing the tolerances to just 4 km/h over the limit.
We have just one question for you – how long do you honestly think you are going to keep your licence for, no matter what state you are in, if you don’t have our information?

The key fact in this article is that only 16% of people just blindly “paid up” when they got their fines and that’s what an impact. We know that if we can get enough people to band together and start sending a united message to these agencies that “enough is enough” by fighting back against any and every unjust and unlawful fine they receive, then we can make a difference.
The only thing holding us back right now is the apathetic attitude of the general Australian motoring population who complain that “it’s too hard to fight back against fines”. I have a residential parking permit. Because I work out of home I don’t check up on my car every day.
I parked my car in the designated parking zone and left it there for a week. When I returned to my car I was shocked to find that I had received 2 parking fines. During the middle of the week the council had decided to change the residential parking zone to a construction zone.
My initial response was to contact the council and explain what had happened. Their response was
“We have examined the details of the penalties and considered the issues you raised. Based on the circumstances you described we cannot, under our guidelines, cancel or offer leniency for these offences. We confirm the penalty notices were legally issued and conclude that the penalties still apply.
The issuing officer reported the restrictions and were clearly signposted as Works Zone. Unfortunately, there is not period of grace when new restrictions are introduced or existing restrictions are varied. They take effect immediately….”
As you can imagine, I was upset at the prospect of having to fight this in court, this was till I came across your material.
I applied it step by step. Not only did I get both fines cancelled, I got a written apology of the inconvenience and a verbal one via phone.

This is why we need to fight EVERY fine we get!
We have been horrified at some of the media articles that have been forwarded onto us by ever diligent Members this past week or so. If the following stories don’t shock you into action then we really don’t know what will.
The first is a story of absolute blatant corruption regarding the red light camera program in Texas – https://www.thenewspaper.com/news/31/3189.asp
The free cars are bad enough but it is all corrupt dealings inside “the system” that allows the program to continue even though they know it was implemented corruptly and even though members voted 3-1 to remove the wording, they got around that too!
Now, although this story comes out of the US, it would be a very naïve person indeed who doubted that very similar things are happening here in Australia.
Next we have a very telling story of double standards from Victoria. The good old Victoria Police are up to their corrupt antics yet again – https://theage.drive.com.au/motor-news/police-speed-warnings-20100707-100nz.html
The opening line really says it all, “Victorian police 25 times more likely to escape a fine when they are caught speeding than members of the public.” Seriously, whatever you say after that, no matter how you try and explain away this fact or excuse it is, quite simply, a joke.
If the police were really there to serve and protect us, as they are supposed to be, if they were truly transparent in their actions then there would be absolutely no need for Aussie Speeding Fines to even exist.
But, as we well know, the police and similar agencies operate corruptly, deceitfully and try and hide as much as possible from the very people that they are supposed to be serving. This is why it is so important to get a copy of our e-book before you get a fine, so that you know all your options and legal rights.
Do, you know the requirements to request leniency in your state? Do you know the correct format for requesting it? Do you know which laws are actually law and which are just “rules” and the important difference that makes to you?
Do you know the Commonwealth laws that all speed detection devices must comply with, yet they don’t? Do you know the site selection criteria that must be followed for mobile speed detection devices? Do you know and understand the guidelines for use – and how easy it is to “create” a false reading – when using a radar or laser gun?

There are so many lies, errors and blatantly deceptive statements on that one web page that we couldn’t possibly mention them all but you need to understand the main ones. Firstly, the opening lines are complete and utter garbage that cannot be substantiated in any way – “Speed is the greatest contributor to road trauma. Mobile speed cameras are being re-introduced to reduce the road toll. Sadly, last year 213 people were killed in speed-related crashes on NSW roads and speeding was the largest contributor to the increase in the 2009 road toll.”
Please spend some time looking over our Vision for the Future page – https://aussiespeedingfines.com/about-asf/vision-for-the-future/ – and check out the statistics that are there. Speed is not the greatest contributor to road trauma at all, in fact, speed is only a factor in 5% of accidents!
Where is the data to substantiate the completely baseless claim that 213 people were killed in speed related crashes? The data simply does not exist yet they will keep using outlandish statements such as this to try and justify the need to extract more and more money from innocent motorists under the completely false guise of “road safety”
The next line is complete rubbish too – “The NSW Government recognises that mobile speed cameras are effective in reducing speeding leading to a reduction in crashes. The introduction of mobile speed camera programs in Queensland and Victoria has reduced casualty crashes in those states by at least 25 per cent.” Again, where is the data to back up these ridiculous claims? Everyone of you reading this must surely understand that if they had any data that could substantiate any of this they would plaster it all over their website – just like we provide substantiated data and proof of all of our claims on ours. The fact is that the data doesn’t exist and yet people will read these statements and actually believe them.
Please, we urge every one of you reading this who is based in NSW, to please let us know which of you the next line applies to – “Recent RTA research indicates strong support for enforcement amongst NSW drivers, with a large number of drivers supporting an increase in enforcement.” What “research”? Where are the results of this so-called “research” and who are the people that actually believe in these ridiculous revenue raising tactics, let alone “support” them?
Finally – because if we mention every point, this e-mail will never end – we have this line – “Mobile speed cameras, like fixed speed cameras, are subject to rigorous regular testing, certification and calibration in accordance with legislated requirements. This testing is conducted routinely to ensure that the accuracy of cameras is maintained.”
It is this line that concerns us the most because firstly, this is a total and utter lie and secondly, because people will read this and think that these devices are accurate and therefore they can’t be challenged and nothing is further from the truth. Please, spend a few minutes reading over our News/Updates page – https://aussiespeedingfines.com/news-updates/ – and, in particular, note the numerous e-mails from Dr Brittain, of the National Measurement Institute, that confirm that no speed detection device currently complies with the requisite Commonwealth legislation as they suggest in this statement.
There is only so much we can do ourselves, we need people to get together and collectively send a message to these agencies that these types of blatant lies and deception will not be tolerated. Someone out there needs to take on agencies like the NSW RTA and ask them to either “put up” or “shut up” – either provide the statistics and data to substantiate these statements or remove them – now.
So, what else can you do to help put an end to this on-going corruption, lies and deception?

Thank you for all the information in the E-book.
I got a fixed camera speed fine (69 in 60 zone) and objected. Police just sent a court date notice, since I disputed the fine, warning that court costs could be added if I did not pay the fine.
I got all my information together since I had your e-book instructions. It was no deal at the first time in court only me saying ” not guilty” and setting a day for my court appearance. Again I had all the information and felt confident ( a truck in line with my car on all pictures ). The prosecuter presented his information with papers on the operator ,appointment of Authorised Persons, test certificate of the camera, photo of “offence” and some other from a delegate of RTA.
The Magistrate started to look at the papers and started to ask what an Authorised person was authorised to do. The prosecutor did not know and I would not tell him ( I had worked it out). Then the Magistrate asked how the various papers related to each other, one did not mention the date and time, another did not mention my registration number and the test certificate did not mention the camera or where it was installed only the measuring device.
The Magistrate just told the prosecuter that this is just not good enough, there is no case. Then he turned to me and asked “and by the way what was your objection to the fine?” I just said that I do not speed along that road I know it too well and that the truck in the picture must have interferred with the measurement. I had lots of other information but as you recommend just thank them and walk away.
But it reinforces your notes to check all the information provided very carefully. I had not made the connection because I knew how the documents fitted together but the Magistrate did not and wanted to get the whole picture fortunately enough.

Further proof from Dr Brittain of unlawful speed measuring devices being used!

First of all I’d like to tell you how much I really love this ebook, it has saved me a high range speeding fine already by going and questioning the operator of the speed camera to find that the operator was using out of date calibration devices to measure my speed on a road that was flanked by metal guard rails over a crest on uneven ground !!!

The story out of Adelaide that shows that the South Australian government clearly isn’t making enough by fining innocent motorists through the use of faulty speed detection device that do not comply with Commonwealth legislation so they have now decided to increase speeding fines across the board.
Seriously, we know that some people out there still believe that the issuing of speeding fines is a good thing. Now, the fact is that more speeding fines are issued each and every year, than the year before and, as a whole, the road toll still continues to climb so how on earth can speeding fines “be a deterrent to speeding” or “save lives” or any of the other ridiculous claims that they make. But, put that fact aside for a moment and consider the following:
Possibly, if they made speeding fines $2,000 each or something along those lines, then people might be deterred – although they would have to prove that A) issuing fines was lawful – which, pursuant to Section 92 of our Constitution, it is not and B) that the speed detection devices they rely on for issuing these fines are accurate – which they are not. However, raising fines by $10 – $15 is going to have absolutely zero effect on whether they are more of a deterrent or not and it is simply a mathematical calculation designed to bring X amount of dollars worth of extra revenue in each year.
Please, we ask every single one of you reading this – over 12,500 Members and Subscribes now – who honestly signed up for, agreed to or voted for this?????

Well, the long weekend is just a few hours away which means the revenue raisers will be out in force as this is the last long weekend – and therefore last chance for them to grab as much cash as possible – for a good 3 – 4 months, in most states.

I recently won my case at the county court (turning right on red arrow). I argued that both images from the camera showed me “in” the intersection, where is the image showing me “outside” the intersection on the red arrow that proves I entered the intersection on the red.
The case was dismissed on these grounds. Keep up the good work. If it wasn’t for sites like yours I would not have contested the case 🙂

The next testimonial shows another typical and deliberate “error” that the police use to fine motorists unjustly and unlawfully – they stand near a change of speed sign and point the device into the higher zone and get your reading there and then state that you were doing that speed in the lower zone but again, using our information, even this can be defeated.

I was booked for speeding in a 40km zone, when in actual fact, the policeman lazered me in the 50km zone.
I went to court and explained to the Judge that the road has both 40km and 50km zones in this small stretch of road, I admitted being over in the 50km zone but was adament I was doing 40km in the 40km zone and that the policeman must have made a mistake.
The Judge said “Due to my good driving record, I am cancelling this offence”.

I reside in Sydney but on 2nd Jan this year I was driving back to Syd with my wife from the Victorian West Coast up the Princes Fwy. In Feb we received a speeding camera ticket for Hoppers Crossing on the Princes Fwy.
Our normal response would have been for me to bleat with some excuse and then pay it.
This time, being aware of your nomination process, we wrote the 1st letter stating that we could not recollect who was driving at the time as we changed drivers in that area but could not remember where it was in relation to the camera site. That was a harrowing morning as it was heavy Saturday morning traffic, an unfamiliar stretch of road and never ending speed camera sites. In all good consciousness, we could not sign a declaration nominating a driver as it could have been either one of us.
They sent back another letter stating that we had to use the nomination form so I sent back a similar letter to the first along with Civic’s Nomination form filled out with similar reason and not signed as I could not make that sort of a statement.
Well, you wouldn’t believe it, last week we received or notice of them dropping the matter. We saved ourselves $146 and one demerit point.
This would not have happened if I didn’t educate myself thru you and the eBook.

Suffice to say that if someone, with a position as senior as Assistant Chief Commissioner of Police, is prepared to go as far as putting this information in an affidavit then there is a serious issue that is going to affect all motorists, no matter what state you’re in.
Please understand, this article proves that the government is aware that the cameras are faulty – which means that entirely innocent motorists will ultimately receive unjust and unlawful fines – and furthermore, these agencies will only do something about it if enough people complain!
So, how do we make it any clearer – our information works, you need our information because the second top cop in the state of Victoria has admitted, by way of affidavit, that the cameras are faulty and motorists are receiving unjust fines and finally, the government will only do something if you complain.

The Australian Sovereignty Party Association, in conjunction with AussieSpeedingFines.com, is calling all concerned with liberty and justice to stand with us in opposition to the criminal use of speeding/red-light/safety cameras, more appropriately known as “revenue raising cameras!”
According to section 80 of our constitution which upholds the right of trial by jury, and according to common law, which requires that at least 2 living witnesses are necessary to testify against a defendant in order that guilt may be established, the use of often faulty and entirely unaccountable speeding cameras, which cannot be cross examined in a court of law, to determine guilt of a traffic offence is illegitimate and unlawful.

Police and media admit the ASF info was correct all along!
Wow, it’s been a hell of a week or so since we sent our last e-mail. The police have been very prominent in the news, as have a multitude of problems with speed cameras and even a leaked report confirming that parking inspectors do, in fact, have quotas they are expected to meet. Mind you, none of this is new or earth shattering, but it is nice to see the truth finally being reported and, for the people out there that have tried for so long to discredit us or shut us down, the following reports prove many of the things we have been saying all along.
So, let’s kick start this week’s e-mail with a report from Melbourne about a police officer who is fighting not only for his own rights but for the rights of all motorists who have received ridiculous, unjust and unlawful fines for minor “breaches” of a speed limit, below the tolerance allowed for by the Australian Design Rules.

Now, any of you reading this who are current Members will know that our e-book explains, in detail, the importance of Section 109 of the Commonwealth of Australia Constitution Act 1900 (UK) – “Our Constitution”. If you don’t know what it says or understand how it relates to these types of fines then please go and look it up now.
As David Galbally, a very well known Melbourne lawyer stated, in this article – “The failure to take this into account or give it any form of consideration indicates to me that speed cameras are merely a revenue-raising exercise.” Once again, precisely what we have been saying all along.
When a police officer puts his job on the line to take a stand for fines such as this and “has plenty of support within police traffic ranks”, then you know our information is correct and we’re starting to make an impact.

Unfortunately, the one thing this article fails to mention is that these speed cameras, like all speed cameras, cannot be tested properly because the initial specifications, pursuant to Section 10 of the National Measurement Act 1960, against which the cameras must be tested, or calibrated, do not exist. Again, the NMA is Federal legislation and overrides any State legislation to the contrary – if you don’t understand this, please look it up and/or grab a copy of our e-book ASAP.

Next, we have an official confirmation from a Sydney Council that proves, once and for all, what we have been saying all along – that Councils do have quotas and force their parking rangers to comply. Now, due to privacy issues, we obviously can’t give out any specific details, but we can tell you that a Sydney Parking Ranger actually contacted us about 12 months ago with a number of documents that prove that she was fired from her position as a parking ranger for failing to meet these quotas. This lady was actually one of the “good guys” who stood up and said “No” when her boss told her, in essence to “fine everyone that even could be considered to be illegally parked and let them fight their way out of it.” How’s that for “those that we elected to protect us”?
We challenge anyone to come forward and prove that this practice does not occur in their council area. Now, most of us think of these “grey ghosts” or parking inspectors as the bad guys – and yes, we would definitely, at some level, have to question their choice of occupation – however, now that it can be proven that they are simply “following orders” that is all the more reason to fight every single parking fine you ever receive – to send a message, loud and clear, to these councils that these practices and procedures will no longer be tolerated by the motorists of this country!
And finally, as if all of this wasn’t bad enough, as if the blatant revenue raising wasn’t clear for all to see, how about this story out of Victoria – the number one “police” state in the country – they now want to fine you for leaving your car unlocked or your window down – https://theage.drive.com.au/motor-news/drivers-face-fines-for-unlocked-cars-20100517-v7db.html
Now, don’t get us wrong, you should definitely be well and truly punished for flicking a cigarette butt out the window – the horrific fires in Victoria last year are testament to that -but seriously, leaving your window down or your door unlocked – come on! Under this so-called “legislation” – which has not been lawfully enacted so don’t worry – you could technically be fined for putting petrol in your car on a Summer’s day in Melbourne – which can easily reach 35 degrees plus – and leaving your window half way down as you walk inside to pay for it!
Seriously, these “traffic fines” are getting completely out of control and these agencies will continue to get away with ridiculous practices – like the ones we have outlined in the e-mail – if people do not start sending a united message and letting these agencies know that “enough is enough”. We elected these people to protect us, to watch over us and to look after us, we did not elect them to fine us for 4 and 5 k’s over limit, to set quotas for parking tickets and “let the motorists try and fight it” or for leaving our window half way down while we pay for petrol and the like.

Important new information for fighting traffic fines!
Our opening story this week is from Britain where studies have shown that when an entire town turned off all their speed cameras there was absolutely no increase in accidents and a spokesperson for the Council involved actually admitted that “Fixed speed cameras are more about fund-raising than road safety” – something we have been saying all along.

Our second story comes from Perth and whilst it directly relates to motorcycle riders, all Members should take note because it just goes to show that these agencies will stop at nothing – including releasing false and misleading information – to raise every extra dollar they can. Obviously, this person represents an extremely small percentage of the population and will likely just cover his rear number plate if he intended on doing something so stupid again – rendering these new cameras completely useless for the purpose that they purport they were intended and instead, subjecting many more innocent motorists to yet another series of inaccurate cameras that do not comply with Commonwealth legislation.
There a couple of other very important points in this article that all Members should note. Firstly, the caption under the photograph, which is their justification for installing these new cameras, makes no sense. They suggest these latest cameras are “the new weapon in the fight to reduce the road toll” yet they refer to the photo of a single motorcycle rider who is only going to kill himself – if he continues to do stupid things like that then no further comment is needed from us in that regard. Also, as we mentioned above, these cameras are almost certainly not going to stop people like that so there is absolutely no proof or justification for that sentence. A camera has never been shown to have prevented a single accident or reduce any road toll at all.
Secondly, the opening sentence is very important – “with police today launching their new weapon against ‘speeding’ and ‘dangerous driving’.” By making the distinction between “Speeding” and “Dangerous Driving” they are confirming what we said earlier – as well as what we have said all along – that, in many cases, “speeding” (as in exceeding some arbitrary limit) is not actually dangerous.
Now, front and rear cameras have actually been in place in many states for many years so this is really nothing new but it is vital to take note of the blatant lie that Police and Road Safety Minister Rob Johnson is peddling when he suggests that these new cameras will be able to recognise up to 4 vehicles per frame and identify which is speeding. This is not what happens at all – one vehicle sets off the camera and all vehicles in a particular photo are sent a fine. This has been verified by sources inside these agencies and we challenge Mr Johnson or the reporter concerned to prove this does not happen.
Mr Johnson’s comment that “Speeding fines are a voluntary tax” is also very telling – at least he’s half right – they are just a tax on motorists, however, it is the agencies that are volunteering the motorists to pay this tax and not the motorists themselves. After all, if these cameras were all so accurate, how is it that there have been so many stories in the media over the years of cameras that have been proven to be incorrect – cameras have been switched off for years – because they were proven to give false readings – and the Victorian government even had to pay millions of dollars in compensation for fines issued from certain cameras because they were so fundamentally flawed.
Completely innocent motorists are being booked, and therefore, unjustly “taxed” every day because of these inaccurate and unlawful cameras – it’s time to put a stop to them across the country – just like they did in our opening story.
Speaking of speed cameras, we have had a number of Members e-mail us over the past few weeks with a very old e-mail entitled “New super speed cameras in Melbourne”. Now, firstly, these cameras are not that new any more, they have been around for quite some time and, we actually answered this e-mail in one of our e-mail updates about 9 months or so ago, when we first received it. You can check all previous e-mail updates, in case you missed them, via our News/Updates page – https://aussiespeedingfines.com/news-updates/ Please just be aware that fines from these cameras, like all speed camera fines, can be effectively defeated using the information in our e-book – specifically the flawed MD5 algorithm argument.
So, if you get that e-mail about the new “super cameras” don’t bother sending it on, instead, pass this e-mail, or at least our details, onto whoever sends it through to you.
And, speaking of e-mails, we have had a number of e-mails from Members this past week or so asking questions about police recordings and videos and if they can use them against you in court. Now, there are a couple of points to note on this topic. Firstly, the police are supposed to inform you that they are recording you but they almost never do so it is important to ask when you are pulled over if they are, in fact, recording the conversation.
If you are a current Member and have read our e-book then you will know that it is important to state right from the outset and re-iterate as many times as practical during the time that you are pulled over that you were NOT speeding. Now, if you have confirmed that they are recording you and you state a number of times that you were not speeding then having the police introduce any recording in court is actually going to work in your favour. However, if you have not followed the steps in the e-book and you are concerned about a recording being introduced as evidence, you can have any recording dismissed from evidence in the same was as a photo from a speed camera, by using the flawed MD5 algorithm argument – in that they can’t prove that it COULD not have been altered or tampered with.

More crazy stories of blatant revenue raising!
Well, we’ve pretty much heard it all this past fortnight – firstly, a guy who was booked for drink driving despite being asleep in his car on the side of the road – and no, the keys weren’t even in the ignition – because he was trying to do the right thing and not drive home over the limit.
Then there was the story of the lady who was booked for going through a red light, despite her being in the middle of the intersection since the light was green, waiting to turn.
And recently, we had a Member whose company was charged with speeding. Yes, you read that correctly, it was his Pty Ltd company – a legal entity that has no physicality and can’t possibly “drive” a car at all – not him personally, that was charged with speeding. Needless to say, when it got to court it was quickly adjourned to try and resolve the matter since that charge cannot possibly be proven.
Yes folks, they are getting more and more desperate by the day. On top of the crazy stories we mentioned above, we have also had a number of media articles sent to us which further illustrate how desperate they are getting.
The first article is about Queensland motorists that are being forced to pay fines that they absolutely do not need to, simply because so many motorists are still not armed with our information before they get a fine – https://au.news.yahoo.com/a/-/latest/7058382/record-fine-tally-as-qld-clamps-down/
It is incredible how the author of this article harps on about how much extra revenue they have now collected but yet they fail to show one shred of evidence that the road toll has reduced one iota as a result of this blatant revenue raising! Not only that, but they flaunt how proud they are that they can now clamp people’s cars and take similar action for fines that have nothing to do with traffic related offences – if only people understood the ramification of the Imperial Acts Application Act “That all grants and promises of fines and forfeitures of particular persons before conviction, are illegal and void.” – this is explained in detail in our e-book. These agencies have absolutely no lawful right to take the kind of action they are and, until people start informing themselves of their rights and standing up for them, these agencies will continue getting away with these unlawful activities.

The holidays are over so they took one last shot at booking as many drivers and raising as much revenue as they could. Again, what many people don’t realise is that your car cannot be un-registered, if it was, how would they know who to write the ticket to. Your car is always registered, at best, they can only charging you with failing to pay a fee which is clearly a civil matter and has nothing to do with road safety or the road rules.
Speaking of that fee, Acting Sergeant Auchterlonie’s statement that “People need to realise that by not paying their registration they are not covered by any [Transport Accident Commission] insurance and insurance companies won’t cover them for any motor vehicle accidents.” is very interesting.
We would encourage you all to contact the TAC and ask for a copy of the “insurance policy” – after all, if it really is insurance then surely there must be a policy that outlines terms and conditions, liabilities etc. As you will quickly establish, this is not a policy at all, simply another “fee”. One of our Members has actually taken this further and established that, as long as you have a licence then you are covered in the event of an accident and your claim has nothing to do with this TAC “fee” at all.
Again, these are just some of the things that people don’t realise if they don’t ask the right questions. Remember, our e-book isn’t just about defeating unjust and unlawful fines, it is about informing you as to what is really going on out there, it is about educating you as to the right questions to ask and it is there to empower you to stand up for your rights – not just on the road but in all areas of life. The whole “system” is out of control and is about nothing more than revenue raising. It is clear that speeding fines are more about raking in cash than making the roads safer, and as a result they have given the law a bad name.’ – is the icing on the cake.
All these speed cameras have succeeded in doing is disconnecting the motoring public from the police and reducing our faith in the government policies that are supposed to be in place to protect us. In fact, the scary truth is that speed cameras have actually been proven to cause more accidents than they save. We are now looking at a way of incorporating this information into our website so that anyone who notices an incorrectly set up camera can take photos and provide us details of the location and time that the camera was set up and then Members can access a page that has all this information and then use it, in addition to all of the information in our e-book, to help fight their unjust and unlawfully issued fines.
So, while we are working on setting this up, we would urge you all to keep an eye out and take down as much information as you can about any cameras you see set up – they are almost always set up incorrectly for one reason or another – and then send this information onto us and we will do our best to get this new page up and running in the not too distant future.

Road Safety – The Facts
Three important facts every road user needs to know about the “speed kills” road safety policy.
1) Speed cameras are doing more harm than good because they are not being used for their intended purpose. Speed cameras were designed to be highly visible and situated at black spots in order to slow traffic, not hidden to raise revenue. Motorists have now changed focus from safety to avoiding the camera.
2) Not even 2% (two percent) of road fatalities are caused through travel above set speed limits. The vast majority of fatalities therefore occur below set speed limits yet there is no road safety initiative on below the limit speeding.
3) Studies used to justify the use of speed cameras have road crash data from ABOVE the speed limit removed.
The current speed kills policy has failed – more of the same is not working.

In our last e-mail update, we shared with you a report that showed that, as a percentage, it was actually the police themselves – the very people en-forcing this ridiculous revenue raising scam on us – that actually have more far more accidents than the rest of us. On a separate note, the Formula 1 Australian Grand Prix, which was held in Melbourne over this past weekend, created a lot of controversy. Firstly, there was the ridiculous “stunt” the police pulled by impounding Lewis Hamilton’s car simply because he “lost traction” for a second as he was pulling out of the racetrack.
Now seriously, who on earth is harmed or disadvantaged in any way what-so-ever, if the former World Champion Formula 1 driver spins his wheels for a second? The Police tried justifying their ridiculous actions by saying things to the effect that “It shows that no-one is above the law and, if you do the “wrong” thing you will be caught.” All it really shows is how utterly blinded they are by their own system and how pathetic we, the motorists of Australia, appear to the rest of the world for allowing this to continue.
In fact, Mark Webber, another Formula 1 great, summed it up perfectly when he described Australia as a “nanny state”. Remember, this guy knows how to drive safely in all conditions and is one of the best drivers in the world. Finally, we received the following report – https://www.theage.com.au/national/victorian-toll-worst-in-five-years-20100328-r4uo.html – which shows that, despite all the new cameras being installed, despite Formula 1 champions having their cars impounded – none of which have anything to do with the road safety at all – the road toll is still actually increasing.

MAJOR BREAKTHROUGH – throws all fixed speed camera fines into doubt!
We’re gonna jump straight into it this week, there has just been a major story that throws every fine from a fixed speed camera into doubt. Please have a look at the following story from A Current Affair immediately – https://video.au.msn.com/watch/video/speed-camera-alert/xbjx8mz
Now, the reason that this story is so powerful is because, when you combine it with the rest of the information in our e-book, it stops any prosecutor in their tracks. Remember, the question to ask – no matter what state you live in – is, “Can you prove to the court that this fine could not have been generated by a camera affected in a way similar to what was exposed on A Current Affair recently?”
As a result of this story, there is now no way of proving if a particular camera has been “hacked into” or not. Therefore, if they cannot prove the particular camera that allegedly detected you could not have been tampered with then the evidence must be rejected and subsequently, you have no case to answer to.
In fact, we would suggest that all Members might like to start incorporating the question above into our 3 step process – specifically, you could add it into the Notice of Objection or the Speed Camera Reply letters.

Again, this is something that we have been explaining to our Members for quite some time now and again, all you need do is ask the Prosecution to prove to the court that another vehicle was not also issued with an identical fine at an identical time. If they were, then they cannot prove that it was your vehicle that was speeding but, in 99% of cases, they will not be able to verify that another car was not sent the same fine.
Please note that the Prosecutor would need to testify under oath that 2 separate cars were not sent the same fine and most would not be prepared to do that because they know that this actually happens all the time!
In fact, when you take a little time to look into things, you actually find that it is those who are booking us for “our own safety” that are the biggest problem on our roads by far!
The story below shows that more than half Victorian cops are being let off traffic fines yet they are crashing more than half of their cars! Talk about double standards, the article suggests that the police have the same rights as other motorists to ask to be let off with a warning. Well, unless you are an ASF Member, you probably didn’t even know that you could ask to be let off a fine and, even if you did, you probably had no idea how to do so. This, of course, is because the so-called “authorities” don’t want you to know this valuable, licence saving information. Instead, they want to save that for the people who crash over 50% of the vehicles – the police themselves.
Now, of course, some will argue that the police spend a lot of time driving (or driving in adverse conditions and across all types of terrain – as per the article) – but hey, so do sales reps, couriers, truck drivers etc. but they don’t crash half their cars – or that the police have to rush off to emergencies. Yet, there is no data to suggest that all of the accidents are happening in emergency situations at all, in fact, they are saying that “covert surveillance” is the biggest issue. Once again, double standards, complete lack of accountability and no reduction in accidents, all in the name of good old revenue raising!
So, if you are as outraged and disgusted by these stories as we are then please, don’t just sit there, do something about it. After all, if people can now hack into these cameras at any time and change all the settings, what possible hope do the motorists of Australia have to think that they can ever be relied upon again?

And, as this breaking news shows, these speed cameras can now be so easily tampered with that the likelihood of you, or someone you know, receiving an incorrect, unjust and unlawful fine has just gone through the roof.

Unfortunately, the whole “system” is now way out of control and, as the Current Affair reported correctly asked – If this is potentially such a massive public interest issue, why hasn’t anyone, such as the Department of Justice, or the company involved, done any kind of press release? The answer, of course, is that it would throw the whole “system” into chaos and there would be a massive public outcry over these ridiculous and ineffective revenue raising devices – which is exactly what we need!
Please remember, this story has so far only been exposed in Victoria but there is nothing to suggest that it couldn’t happen, or isn’t already happening, in other states. Again, the onus is on the Police to prove, beyond a reasonable doubt, their claim against you so make sure you use this new information, no matter what state you’re in, to your advantage.

Overwhelming Proof that the ASF system really WORKS!
Well, it’s only barely been a week since we sent out our last e-mail update and we have been totally inundated with amazing new stories of success from our Members.
A number of people have reported back saying that parking fines have been dropped as soon as they elected to have the matters heard in court. Others have beaten parking fines and speeding fines in court with very little effort and we even had a Member who adapted the ASF system to defeat two ridiculous “un-registered dogs” fines! Important licence saving information concerning speed detection devices.
First up this week, we are continuing with reports from the on-going battle between South Australian Independent MP, Dr Bob Such. In case you missed it, please check our News/Updates page – https://aussiespeedingfines.com/news-updates/
Dr Such has asked what any reasonable person in his position would – to have the device that allegedly detected him speeding independently tested. Now, you would think that the Police would be eager to verify their claims that these devices are accurate and put an end to all the speculation that they are not and allow Dr Such and his legal team to do this testing. The story below shows that this is clearly not the case and, worse still, their excuse for not doing so is an absolute crock! Now please, what on earth does a manufacturers “marketing rights” have to do with someone’s common law right to be treated as innocent until proven guilty? Surely someone’s right to free travel– as per Section 92 of our Commonwealth Constitution – must take precedence over some corporation’s “marketing rights”! Besides, how exactly would their “marketing rights” be affected just because the devices were tested – unless, of course, it was proven that they were inherently inaccurate!
Yes, we know exactly why they won’t let this happen – for the very same reasons as the Victoria Police dropped the high profile case against Sam Newman this week – because they know they are booking innocent motorists simply to raise revenue.

Now, what Sam should have done is what John King did and get a court order for costs against the police for wasting his time. All too often these agencies try and threaten motorists with case history of huge legal bills for people who have fought fines and lost but what people don’t realize is that when they are armed with the Aussie Speeding Fines information they will almost certainly win and then, they can claim costs against the agency that insisted on taking them to court.

This story is extremely relevant right now because we have been hearing feedback from a number of Members across Australia that the various agencies are now going to extraordinary lengths to try and claw back some of the hundreds of millions of dollars they are losing in revenue because so many people are now successfully using our system to fight back.
In WA, there was a report that unpaid fines have now soared to $241 million – https://au.news.yahoo.com/thewest/a/-/wa/6797660/unpaid-fines-grow-to-241m/ Also, there is a suggestion that instead of suspending licences for unpaid fines – which has been proven not to work because any such licence suspension is null and void – (please see our e-book for full details on why this is so) – they are now going to resort to clamping people’s cars and even traveling to their homes to do so. Now, in case this worries you in any way, fear not as we have had a number of Members who have been in this situation and they have actually cut the clamps off with an angle grinder and sent the Sheriff’s Office a bill for storage of their clamps! People don’t realise that once these clamps are fitted to their car they become a fixture of the vehicle and therefore they are now the property of the owner of the car.
What’s more, all our informed and educated Members know that all these fines, suspensions, wheel clampings etc. are completely unlawful and un-enforceable because legislation that goes back to the Bill of Rights clearly states that “That all grants and promises of fines and forfeitures of particular persons before conviction, are illegal and void.” More often than not, these fines and subsequent court orders are made in courts that have no lawful power to do so. Furthermore, in Victoria, they are actually running radio ads from the Sheriff’s Office offering an amnesty on fines and they’re saying that if you pay your old fines by a certain date then they will waive all the additional fess – which were illegal in the first place! But seriously, how desperate must they be to actually run radio ads for this kind of thing? It just shows you beyond any shadow of a doubt that people have had enough and are now successfully fighting back against these ridiculous, unjust and ineffective fines.

On a separate note, we have been getting the same e-mail from many Members over the last month referring to all the new speed and red-light cameras that are being installed in Queensland. It is important to note that these cameras have been in use for many years all over the rest of the country already and have also proven to be inaccurate and fines from these cameras have been successfully defeated by many Members – and yes, even including the time over distance cameras as well.
One of the keys to this is in the Transport and Main Roads “fact sheet” that usually accompanies this e-mail. It clearly explains how the new cameras are all digital and therefore, none of these photos can be used against you in court if you use the flawed MD5 algorithm argument – again, if you don’t understand what this is, get a copy of our e-book now so that you do. Also, who is the Informant in the matter? The camera. Tell them that you want to cross examine the Informant on the stand – they obviously can’t do that.
Now, the biggest problem with the document that usually accompanies this e-mail is the blatant lie that all cameras will be tested and certified to be accurate – they are not and they can never be! The many previous e-mails we have sent out from Dr Brittain explain this further and a full explanation, as well as a copy of the relevant sections of the national measurement Act 1960 are all contained in our e-book. Anyone know any lawyer that wants to start a class action suit against them for false and misleading advertising?
So please, next time you get this e-mail about new cameras being installed, do not pass it on. Again, these cameras have been proven time and again to be inaccurate and the simple fact is that fines issued by these cameras are very simple to defeat if you have the correct information.

Some VERY interesting developments!
Firstly, we would like to thank you all for your support and patience with us during our recent website and e-mail server issues. When you read some of the points below you will understand what a huge impact our Members are now making on “the system” and why these agencies resorted to the underhanded tactics that they did and hacked our website.
Anyway, with the help of our very dedicated web guys, we now have a whole new server as well as an updated version of our website software package, which should hopefully ensure things run smoothly for a long time to come. Many of you will have no doubt noticed the slightly updated format of the website, including the new “articles” section which appears at both the side and bottom of our Home page. We would urge you all to keep sending through these media articles and reports and we will do our best to keep on top of them all and update them as regularly as possible.
Speaking of articles, we have a number of very exciting things to share with you this week, not least of which are the following reports of South Australian Independent MP Bob Such’s fight against inaccurate speed detection devices. We find it incredulous that the police would blatantly lie, in court, when up against a Parliamentary Member. The Prosecutor’s statement that these devices are incapable of giving a false readings is an outright lie that all our Members would be well aware of because the Police training manuals outline the numerous ways in which the devices can give false readings. Accordingly, we have contacted Dr Such and given him our full support and we would encourage you all to get behind him and to also request your own local MP’s to join in take a similar stand.
We have also recently heard a number of reports from Members that have successfully used the flawed MD5 algorithm argument, or a version of it, to successfully defeat fines in QLD, NSW and SA. Remember, the key to winning this argument is to ask the Prosecutor to provide expert testimony to the effect that the photo from the camera “could” not have been altered or tampered with. If they can’t do that then they can’t rely on the photo as evidence.

Speaking of feedback, we have received a number of e-mails over the past few weeks purporting to be from someone on the “inside” at the QLD department of Transport with “foolproof” information on how to pay a fine and avoid demerit points. Now, this e-mail raises its head every 6 months or so in one form or another – usually when the States are desperate for some additional revenue. The e-mail reveals that the “secret” is to send a cheque and overpay your fine by a few dollars and you will receive a refund cheque for the overpayment and, if you never cash the cheque, you won’t have the points applied to your licence. We have detailed this strategy in our e-book so it’s obvious that people who are forwarding on these e-mails are not our Members. Now, this strategy used to work, a very long time ago. This loophole has now been closed in every state and does not work anymore.
So please, if you receive an e-mail like this then do not forward it on, instead, delete it and pass this e-mail on instead. As you can see, it is a great way to trick people into paying their fines and then they cop the demerit points anyway. Hopefully, you can also see how valuable our e-book, and the information contained in it, really is. There are idiots out there trying to suggest that our information doesn’t work or that you could get into more trouble by using it, when clearly, as you can easily see by this example, our information is the truth and you could actually get into a lot more trouble if you don’t have it. Our most comprehensive Testimonial yet – a must read!
Well, we have had a busy week trying to restore all our Testimonials. We have a lot of them back up again but we are still trying the get the remaining ones back up which show beyond any shadow of a doubt that, no matter what state you live in and no matter what unjust and unlawful traffic fine you have received, if you follow our system then you can and will win!

Twelve months ago I started to fight a parking fine issued by Sutherland Shire Council. The usual replies and denials occurred and the State Debt Recovery Office became involved. After two annulment applications later the matter went before the local court for mention. The Magistrate was not happy with my knowledge and ability to self represent she even threatened to deny my case if I did not consent to the courts legal ability to hear this case (not a court of competent jurisdiction) so I replied ” your court has the ability to hear this case how ever only a verdict in favour of the defendant can be handed down other wise the court would appear to show bias in this instance and this is the reason why a court of competent jurisdiction is required so as to remove any bias” how ever she pondered and had no choice but to allow the matter go to a Hearing with two(2) hours allocated for this matter. The SDRO said they did not require two hours, the Magistrate disagreed.
Two weeks before the hearing date the Sutherland Shire Council wrote to me advising that they would not be pursuing the matter any further but warned me they will retain this information if I breach any council laws in the future.The SDRO then rang to advise me they have elected to drop the matter due to the Councils decision to cease any further action and I would not be required to attend court in this matter.
I advised both the Council and SDRO that this hearing was under my control and I was the only party that had the authority to cancel this court action and if both the Council and SDRO wished to have me agree to their request for this matter to be dropped they would have to pay compensation for my costs being:
2 x annulment application fees
Postage and stationary
1 x days wages for two defendants
The SDRO officer spoke to his manager and they have agreed and have put this agreement in writing and have advised the necessary authorities that this matter has been settled out of court through a private agreement.

Now, every so often, we still get some mis-guided people e-mailing us who have bought into the media propaganda that speeding fines are still somehow something to do with road safety and revenue raising is simply a by product. Well, let us share with you a few stories that will well and truly put that to rest.

On a similar note, the Assistant Commissioner of the Victoria Police is forced to admit that the new “Anti-Hoon” laws simply do not work – https://news.ninemsn.com.au/article.aspx?id=1000851 You will notice that the media very cleverly bury this telling fact in the midst of what is clearly a very sad and tragic story but the fact remains that the current so-called “Road Safety Policies” are simply not working.
And yes, in case you were wondering, this is the very same Assistant Commissioner of Police who fronted all the TAC ads over Christmas telling everyone how dangerous speed is and then covered up the fact that he got a speeding ticket himself – https://news.ninemsn.com.au/national/1000042/top-traffic-cop-kept-speeding-fine-secret
There are so many comments we could make here but we will keep to the facts and leave our opinions out of it. Given Assistant Commissioner Lay’s prominent position both in the Victoria Police Force and as the face of all the TAC ads, it would be fair to assume that he would be the most careful and conscientious driver on the road – after all, he would hate to have a story get out about him speeding and going against the very campaign he put his face to. So, if he did, in fact, get a speeding ticket, despite being so careful and conscientious, it tells you one of two things – either the speed limits are set so artificially low that even the most careful driver in the state cannot stick to the speed limit and/or the speed camera that detected him allegedly speeding is clearly as faulty as all the other speed cameras out there because surely Mr Lay, of all people, would not speed! We’ll let you be the judge but, either way, rest assured that if Mr Lay can get a speeding fine then it is all but inevitable for you.
So, we know that speed cameras do not have anything to do with road safety, we know that they are often not even set up in blackspots – but are clearly installed simply to raise as much revenue as possible – and now we know that even Victoria’s top traffic cop can get a fine so, what can you do to protect yourself against the current corrupt and ineffective system? Why the ASF system is causing the authorities some REAL headaches!
Firstly, we would like to extend our apologies to anyone who had troubles either accessing our website or getting replies from us over the course of the last few weeks. Just after we sent out our last e-mail update someone hacked into both our website and our e-mail server, knowing that all our web guys would be away for the Christmas period and making it all but impossible to rectify properly until now. We have access to – and the support from – some of the top web and IT guys around and they said it was a serious breach so it appears as though we are causing some real headaches for the “powers that be” and they will go to extraordinary lengths to try and shut us down!
Anyway, for the most part, we have the website back up and running again – all-be-it with a few glitches and missing links – but, most importantly, our e-mail server is back up and running. So, if you sent us an e-mail in the past few weeks or so and didn’t get a reply, it is not because we were ignoring you, it was because of the issues outlined above so, if you still haven’t received a reply, just forward us your question again and we will get back to you ASAP.
So, why is the Aussie Speeding Fines information causing such headaches and problems for “Powers that Be”? Because so many people are now successfully fighting back that “they” are really starting to feel the pain. Thus far, “they” have tried putting up all kinds of rubbish about us on the internet – all of which we have quickly and easily re-butted – and “they” have tried to discredit us and say our information doesn’t work – yet we receive testimonials from Members every week now saying that it does.
Not surprisingly, the one web page that was hacked into and affected the most was our Testimonials page – now, that says a lot in and of itself. We are currently trying to retrieve backups and get everything loaded back onto this page so please keep checking in as we will not only re-instate what was there but also add some new ones ASAP.
Speaking of new testimonials, we received a number of reports back from Members over the Christmas period that ranged from quick success – after writing just two letters – right through to a Member who has been fighting one fine for over two years and finally beat it! We have received many others as well but we have included those two for you below so you can see for yourself that, despite what certain so-called “authorities” would have you believe, our system really does work!

Now, this guy had to work a little harder because he was also facing a licence suspension as well as a taxi licence suspension but, he got his victory in the end. How many people would have just blindly paid the fine straight off and then had to deal with being off the road for 6 months? This guy would have lost his licence and his livelihood and income if he hadn’t fought back!

Back in October 2007 I was pinged twice in two days and topped 12 points on my licence. I took the proffered 12 months deferred suspension and was doing well until October last year, when I was pinged again.
I received a TIN for an alleged 58kph in a 50 zone. This was, of course, reduced to 55kph with a $142.00 and one point penalty.
I followed the Three Step method and, over the next eight months I exchanged five or six letters with an ever increasingly threatening Civic Compliance, Victoria Police and the Magistrates Court of Victoria (all housed at the same address in Melbourne).
As things moved along, I was informed that my drivers licence was suspended from August 2009 and, subsequently, my Taxi Drivers accreditation was also revoked.
I finally got my day in Court, albeit in front of a single magistrate, in November 2009.
The beak wanted to know why I had sent all these letters, “which don’t work. And this rubbish about Constitutional Rights won’t get you anywhere, either”, and why I hadn’t just filled in the form on the back of the notice asking for a court appearance in the first place.
He reluctantly agreed to “allow” me a court hearing and the case was listed for Mention in January 2010 – 15 months after the alleged offence.
Referring to the South Australian case, in which the unreliability of radar devices in the vicinity of High Tension cables was successfully used as a defence, I made an FOI request seeking all speed readings from the same day I was pinged.
On the 22nd December (the Equinox for anyone into that stuff) a letter arrived from Vic Roads informing me that the TIN had been cancelled and that the offence, along with the associated demerit points, had been removed from my driver licence record. It also informed me that my extended demerit point period had ended on December 31st 2008!
I’m not sure whether it was the time limit or the FOI request that made them give up, but I have now sent copies of Vic Roads’ letter to the court asking for the case to be dismissed and to the Taxi Directorate asking for my Driver Accreditation to be reinstated without record of any offence.

The first is probably the most ridiculous and offensive story we came across. It is about our good “friends” at Australian National Carparks who have absolutely no legal authority to issue a fine at all and, if you get one of these fines from a private car park then immediately apply the 3 step parking process from chapter 3 of the e-book as these fines are the simplest of all to defeat. The following story is a lovely little media spin, trying to convince people in NSW why they need to bring back mobile speed cameras. Unfortunately, it is full of lies and fiction – they suggest that “the current fixed camera program is having significant results in the reduction of fatal, serious and major crashes” – what the article fails to mention is that there were 85, yes you read correctly, eighty five more fatalities in NSW in 2009 than in 2008, a total of 459, despite having more speed cameras operating than ever before. Not only does this article expose the truth about the real reason behind speed cameras – being plain and simply to raise revenues – but the author also backs up perfectly everything we have been saying about the need for better driver training and education.
The simple fact is that the current system has absolutely nothing to do with road safety and is simply about raising revenue. The media finally reports on the dangers of speed cameras!
Firstly, we would like to wish you all a very Happy New Year! We trust that you have all enjoyed your holidays thus far and that 2010 is an excellent year in every respect for you.
Okay, so moving straight onto our main point for this e-mail – we have said it many times before, speed cameras actually increase accidents. Well, now, even the mainstream media, right here in Australia, have confirmed that the speed cameras here are also a very big threat to road safety – the very thing they were supposedly implemented to improve. This report shows what a danger these cameras are on our roads and re-iterates our position, that they should be removed from service in this country.
